credit card/credit report success

It has been a long road (12 months) but, I finally have a success story worth sharing.& In the past, I have had small successes on a day to day basis using honor/dishonor techniques but, this is a CTC3 based success!


A third party debt collector was ruining my credit report with an unverifiable debt (like all of them).& First I notified the credit card companies of this debt collector.& I was getting phone calls at night and everything.& I wrote a letter to Trans union on Aug 26 demanding they verfiy this debt collector.& they wrote back asking me to dispute the entry on my credit report or my demand would be considered frivilous.
I wrote back citing USC Title 15, chapter 41, subchapter III and I basically wrote them stating that I cannot dispute an alleged debt that is not a verified debt.& By disputing the debt, I agree that there was a debt by default (negative averment on their part).


To make a long story short, I wrote that letter and tendered a VOD to the alleged debt collector on the same day (Sep 29, 2003).& Needless to say, the phone calls stopped, a certificate of non-response is being prepared (as I type this) and I just received notification from Trans Union that---that particular account has been deleted from my file.


My documents were made according to their response.& there is no boilerplate template that I used and I re-wrote the VOD to fit my situation!& Folks, this stuff works!!& Thanks Ice, JHD, OT, rocket, and Jason for your posts on this issue prior to me taking action.


Furthermore, I did the same procedure for a few other items on my credit report and they were all deleted as well.& I know some members will want to see some documented proof so,&Sui Juris&PM me and give me a fax number and you may use the docs I used to accomplish this for the members!&

I do believe that any collector "defaults" when they cannot/do not provide verification of an alleged debt and must also be served with an Affidavit of Default, which a copy of could be used to assist in the deletion of any item listed with the CRA's.& This will also assist in a motion to dismiss any possible court action they may attempt to bring against you&thru a third (or 4th or 5th)&party collector.& It could also assist in receiving an award of damages should anyone continue to smear your good character with reports of these unverifiable "debts" and slanderous accusations of being irresponsible towards your obligations.

That is exactly what I'm waiting for!& that is why I mentioned to the forum that the deletion letter that Trans Union sent me is a smoking gun should they proceed any further than they already have.& Not to mention my copyright notice will be infringed as well.


I'm not looking for money but, if they want to just give it to me, I may conditionally accept their offer to be paid in gold and silver and not FRNs.& whadaya think?

<FONT size=3>Well, now I know why the CRAs wouldn't delete the Notices of Tax Liens from my credit file: I filled out a dispute form and admitted that alleged debts were valid on my part!& I never understood how they could return a verdict so fast saying&the liens were valid -&it was like they never made an inquiry in the first place.</FONT>

Have you seen the Affidavit of Default in the downloads?& Note: they confess "judgment and estoppel in favor of Affiant".


The affidavit could be a template to use with your process... whaddya think?
