The information that the 2 CRAs in Canada have on me, shows payments made on time, not even one payment 30 days late. So in that respect, things are excellent. The only derogatory item they have is a speeding ticket that went to collection in 1999, which I paid after I got the letter from the collection agent (silly me, but I didn't know then...) The score that they have on me is low, because of the amount that I allegedly owe on the credit cards.

I am going to send the 2 CRAs the letter requesting "certified verification" for each item on my credit report. Once I receive confirmation that the items have been deleted (because they will not be able to verify the debt) then I will move on to the Credit Card Companies.

Am I going at this backwards? I figured that I would keep making my monthly payments until I have proof that the CCs have been removed from the credit report. I guess that I need to take this one step at a time, but I don't want to mess things up by taking the wrong steps...

Enough of my ramblings! Any ideas or suggestions? (remember that I am in Canada and I am not sure what codes or laws are the same as the US, my bad for now)

If you continue to pay, you just verified it.

Also, you need to find all the Law in regards to "banking" (lending of credit, etc.). You must be able to uncover the fraud being perpetrated upon you via the CCC's. This would be the "kicker" to all the other "verification" that you do.

One thing for sure -- do they have an original agreement with your signature upon it?

dalrex,

When dealing with a CC it might be wise to research "breach of contract". The CC stated they would "loan" you the money for the purchase and you would pay back the loan with interest.

What they didn't tell you is that you are the one funding the "loan". Instead of the bank loaning you money, the bank withdrew funds from your transaction account without permission, authorization or your knowledge and returned the funds to you, falsely claiming they loaned you money.

If the attorney claims that to be false you could prove that the attorney brought a fraud on the court (as well as making false statements). The attorney could claim that the bank operates that way... and you claim it was never agreed to. Are the terms of the agreement clear and unambiguous?... whose account was to fund the purchase of the merchandise?

You need a material fact... The issue is whose account funds the purchase of the merchandise?... you or the lender? Did the "lender" "loan" you something? Or did you fund the purchase?

Interesting... isn't it?

Just an update...

I got back from holidays and received a letter from Equifax and TransUnion. Equifax sent me a copy of my credit bureau and included a standard form to fill out to make changes to my address or dispute information. TransUnion sent a letter stating that I did not send them proper identification, so they were unable to send my credit bureau.

Did they not read the letter that I sent to them??

I am sure this is just part of the game that they play.

What would my next step be?... a letter stating that they have 30 days from receipt of the original request to provide "certified verification" or ...?

p.s. also had a call from CCC re: account is overlimit, when will payment be made? I first said " I am not sure what we are talking about here." his response was "this is in regards to your XXXX Visa with a credit limit of $XXXX." I said "I don't do business over the phone, can you please send this in writing" he hesitated and then said "yes, I can do that... have a nice day.")

What do they consider proper identification? What did you include as identification?
