I too have received a second notice from the NAF dated Jan.14,2005. I must say I am alittle frightened by this. I have never delt with these people before and really uncertain as to what to do. I have a bad feeling that my doing nothing, as I have been doing, is not good. Can anyone offer any help? Should I ignore them? Should I send a reply? If I send a reply what should I say.
When I recieved the first notice of going to before the NAF, from those goones from Atlanta, GA, I sent him a copy of an award that I had already went before an arbitration form, a form of MY choosing, but they proceeded with NAF anyway and sent me this second notice.

Do not agree!!!

Do not ignore their letter!!! Send them a letter stating you do not agree to participate in their fraudulent hearing. Remember, they must have your permission to continue, but if you ignore them, your silence is acceptance to the hearing.

Gregtu - I sure wish I had your advice weeks ago! I had the same situation as 1sissygirl and I ignored them. I just received their (MBNA) arbitration award against me. So now I have an arbitration award against them dated Nov. 5, 2004 and they have one against me dated 1/07/05! So do you know what happens now? Do the 2 awards just delete each other out? or do I just sit and wait to see what MBNA has up their sleeve next?
Any suggestions?

Did you file your Award at the courthouse?

Which one is 'public"? Yours or theirs? If you read back through this and other threads, you will find that there is some thoughts that one must use the court for "public recognition", a public witness, if you will.

You can file an appeal with the NAF -- but do you want to? OR do you want to do an A4V and discharge the 'debt"?

[color=RoyalBlue] ras, check your PM's please. Here is what I am thinking Yours came first. More than likely and I am just guessing that they will push forward if you let them. Don't let them push you around, they will try. I have had to deal with a so called head supervisor of the customer department with MBNA on the phone before. Just as a potental client...this woman was so rude and nasty to me, the potental client, I told her that if I ever received another piece of their gargage in MY mail box ever again I would sue her and that company.

I did it and guess what the attorney requested that the case be Stayed and guess what else the NAF Director granted his stay request.Uhm sounds like I just got ignored again It is really nice that they at least let you know that they are ignoring you. I am not giving up or in.

Check other threads, I had the exact same situation, sissy -- and they came back again when they thought to catch me off guard, I guess. Be vigilant.

Ras, what if you send a copy of your Award, with a demand for proof of status to NAF and politely point out that your award supercedes the CCC's through them? In fact, I think I would go ahead and download the letter gregtu referred to and modify it to reflect the above.

Worth a shot, and maybe others have a thought about the filing in the "public" of your award, BEFORE they do the same to you! Time/date stamp your copy and make a copy to send to NAF.

Thanks for you valuable input. I am with you on this as far as Ras sending a copy of his award not only to the creditor and the NAF but to any one else that wants to jump in on this wagon, claiming their involvement. Send it to ALL of them. In my case I am dealing with 4 different people, 3 of which claim to own this same account and want to collect :confused: . Ras can expect to get his award copies sent back to him, as I did- those bullies! :evil: But send them anyway that way they can not say they did not know. They will shove those arbitration provisions at you, you know the ones that you supposedly agreed to :confused: . Those are meaningless because they have not showed me where I agreed to a damn thing. If I did not agree then I can not and do not have to follow those/ their provisions. They will say "you used the card and that was your agreement." Well, no I did not. If someone did it was not me. Show me where it was me please.

Thanks for the response. I've been out of town for the last 9 days trying to get away from all this stress (and the repo man - another case) ha Got in about midnight driving straight through all night in the fog and rain so I am braindead right now. I've got a full van to unload and kids to put to bed so I will re-read all info tomorrow night and check up on those thoughts and let you know the latest. Just wanted to check in and let you know I hadn't dropped off the face of the earth!
