Angry This is weird need advice

Let me start by stating the summons was left on my door. I thought I had to sign for it but it was just there.

Oay here I go. The summons is for 2422.52 and from a creditor I have no idear who it is from.

I know I had credit cards 3 of them 10 years ago and have had no contact for over 6 years even 10 in some of them (college youth). My other loans like one for my car paid off and school loans am on a payment with them. So I'm guessing this should be from a 3rd party collector in my case like the 10th one.

I ran a credit report thinking I would see the amount or an amont close to it and figuree out who it was from. But on my credit report there is nothing for that amount. Not even close. It shows a lot of different accounts I'm guessing as my accounts were sold off they were then listed as "thiers" and such my report ends up with a bunch. Since reading good stuff on here I'm going to clean up my credit report.

The only two amounts on any of the accounts is like $8,000 and $4,000 which is not the amount in the summons.

Also it says I signed an agreement to repay the said amount. I have not signed anything in years saying I would pay anything other then my car payment. That has been paid off and title in my name.

Could they just make that up? Thats pretty bad. Are they hoping I would not respond and they would win by default?

So I say the hell with it I'm getting a lawer. Will it be hard to find a good lawer who would help me out?
I would love to see what everyone on here thinks. Any insights I've been reading and searching all night. So when I get a lawer I know something to make sure he knows his stuff and can help. Anythoughts or ideas would be great.
P.S. sorry for bad spelling and grammer been a long day with little sleep....

You need to do some studies, by starting out @ suijuris forum under Banks, collectors, and CRA for more detail with your situation.

Yes, Welcome to the board!

1st thing I'd check, is to see if the statute of limitations ran out in regards to being able to bring a suit against you. In California it is 4 years from the date of the first missed payment.
If the statute of limitations has expired, you don't have to send in a cent and you don't have to reply to anything.

Other than that, start reading the threads here, all that you can. I also recommend reading items in the download section on this site.

There are actions that you can take that will do away with the suit. Collection Attorneys are becoming a lot easier to deal with... even if they have already filed a cause of action.

Just don't blow off the court date or the creeps win by default (which they are hoping for) A competent Consumer Advocate Attorney would be a big Help. It sure seems like some jive is going on! SOL would have run its course by now and I don't think the skunks could "re-age" the debt for that long(10 years!) Filing a Cross Complaint against them puts them on the defensive and gives you some leverage against their attack. Jaylon has been suing these creeps and winning some of his suits already. If this Suit is some frivolous attempt at squeezing money out of you, then they should be sanctioned and fined by the court. It is your right to send them Interoggatories to begin the "discovery process" You can do this even before you have your first appearence in court. A motion for Dismissal for Failure to State a Cause of Action (SOL thing) It sure sounds like a fishing trip by some skank debt attorney.
