forclosure nightmare in florida

my head is about to explode, i want to rub GMAC face in the dirt.........
my mortgage was used to changing lenders, seems like i was always getting a letter telling me i have another servicer. So i get another one and i send them the checks and soon some woman is knocking on my door asking if she can buy my house since gmac has put a foreclosure on me so i say, i think you made a mistake i dont have gmac anymore, WRONG, it seems even though the new company sent me a letter saying they have my loan they only have the (2nd) when i bought my house i was given a 1st and 2nd, which everytime they changed hands went together, except this time, so i call the new company and how happy they are with me that i have paid a 275.00 bill so far in advance, hahaha
so i call gmac and tell them the story, fax them all the reciepts and tell them the other company wont refund me and i dont have the money to pay them, and i tell her about the paper i got that i have 20 days to fill out telling the clerk why i shouldnt be foreclosed on, and the girl tells me disregard that, i will contact them and we can make a payment arraingment, liar!!! soon after i get a letter from the court telling me i defaulted because i didnt fill out the paper, so i call gmac back telling her i got a court date now that i didnt fill out that paper, just disregard that i will fix it she says, im thinking my ass i will disregard it.........good thing i went, yes they did call my name, and i got a 60 day extension, then i get a fedex from gmac telling me to pay them 2,000.00 by today and all these other legal fees or lose my home, so today i called a bankruptcy lawyer and i have appt next week, can they just do this to me????????? oh and they say they lost the note, i read some stuff about that on this forum, the judge was busy so he didnt have time for it he will deal with it in 60 days i am so angry at myself for believing that rep....I dont know what to do,i have got to buy myself some time so i can figure this out, i dont have money to go out and hire attorneys otherwise i would have given the 2,000.00............

Yes indeed! Welcome and unfortunately welcome to America these days. Really the mistake was being attorned in the first place - to believe a third party sending you a letter telling you to make payments elsewhere. But for all I know, the novation was intended and orchestrated by the GMAC company to get you into the muddle you find now. And they probably orchestrated that lady on the porch too. (The sixty days is a facade to appear to be giving you due process.)

In other words overall, the banking industry is going through something driving it to start imposing foreclosures, rather than wait for them to happen.

For whatever reason people have a difficult time understanding the simple matter of putting corporate banking policy into place. During the thirty day notice I refused the final rule for cause. So the banksters are implementing the much-less-final Basel II Accord and having a difficult time finalizing that. So meanwhile the foxes are getting scared they will have to abandon the henhouse and starting to gorge themselves. (See attachment - I was reading your post when the kit walked up; makes me wash the window more often too.)

You are a victim of simple greed. To keep your house you will likely have to play the game; pay up the fines etc. and you will probably find them raising the interest and payments too because you are such a bad person. There are things you can do to expose they are criminals but you will have to be the court of competent jurisdiction building a record. When enough people are sui juris (forming proper juries) then that may be the kingdom of heaven of the Holy Bible. Until then, they just go into feeding frenzies like with you.

Thank you for the welcome and the comments hopefully soon i can make some positive, helpful posts to the board that will help others.....

I spoke to the 2nd holder and told them what a mess i was in with gmac and that i hoped to rectify the situation soon and get a new holder who will hold both the notes and then i got a credit alert and it was them checking my credit. The person holding my file there seemed very nice and told me a few things about some of my rights that were violated i kind of got the feeling they may be interested in getting the 1st note, so we will see, he is going to call me back on monday.

Dear Novsar;

I certainly hope that coming across friendly and caring people who will explain your rights etc. is a good sign that there is light at the end of the tunnel. Sadly though, after coming across people like you did who treated you like that, you might look at a few polite people a little too optimistically.

That kit video was really nice.

I was rehearsing outdoors with a marching band by the Fox River (Illinois) a couple of years ago, and a full grown red fox came up the bank and lay under a tree about 50 yards away from us for a while like he/she was listening, and then got up, checked us out for a few seconds and returned from whence it came.

I thought it was pretty awesome.

The fox was beautiful.
