Political Decisions and Judges

does anyone have any case law which prevents judges from making political decisions about a person? ( citizenship, etc.)

This may or may not be what you need:

"While the Fourteenth Amendment "was intended primarily for the benefit of the negro race, it also confers the right of citizenship upon persons of all other races, white, yellow, or red, born or naturalized in the United States and subject to the jurisdiction thereof." In re Rodriguez, W.D.Tex.1897, 81 F. 337."

I hope it answers your question

political decisions?

Cohens v Virginia, 6 wheat (19 U.S.) 264, 404 (1821):
Chief Justice John Marshall said "We [public servants] have no more right to decline the jurisdiction which is given, than to usurp that which is not given. The one or the other would be treason to the constitution."

There was a crash Saturday. Wiped out some messages posted during certain times. That's all.

(Personally, before I'd think "censorship," I'd be thinking government at work....! But that's just me. &)

Randy,

a good point but it is normal for computer systems to crash. Especially if it is a server type of system that needs to be conitually on. I'm more than confident that SJ has a back up to his back up. ;-)

Re:Political Decisions and Judges

There is a post in the misc. discussion re the database crash. As Jerseee stated, it is not unusual for computers to crash from time to time.

There was about a 12 hour gap between the newest backup and the time of the crash, so about 12 hours of posts were lost from that time period... unfortunate I know, but far less so than the previous crash. As you may recall, there was no recent backup and months of information was lost that time.

Regards,
Sui Juris

If so, there are no absolutes, and the only logical conclusion is that reality, truth, and right and wrong are determined arbitrarily on a daily basis by those with the most power, guns, and money, and the rest of us can choose to run, fight, or be their slaves.
