Attacking Presumption of Debtor/Slave

I've noticed that on this board and most others is that we all tend to be very reactive and defensive when it comes to our interaction with "the system"

What about being proactive? Has anyone explored petitioning the courts for some sort of injunctive releif against the state and its agencies (e.g. Public Safety, Highway Patrol, etc.) demanding they create a way for their computers to recognize those of us who are traveling in our soveriegn capacities (either by issuing special traveling cards and/or plates or perhaps issuing us a Certificate of Soveriegn Right of Way) so that the police and other enforcement don't act with the presumption that we are mere subjects?

Perhaps i'm on crack.

I would be interested to hear everyone's thoughts on this.

Attacking Presumption

Heard rumors about a man who filed for a judicial determination...am I a slave or sovereign?

Sorry it is so vague...I think....grimace...

overstood. . .

<font size=4>. . .then I invite you all to send me a private message on this topic![/color]

I started doing a preliminary review on "Diplomatic Immunity" and Interestingly enough, it seems most (if not all) of the "privileges" enjoyed by those with this status are the same as how I envision the Soveriegn's status should be enjoyed.

Something to think about. . .

Blacktruth,

It is natural for folks to get defensive and react to a wrong. What is not too common is proper planning. SJ has posted somewhere in the UCC or Travel forum--the same thing you speak of "INJUNCTIVE RELIEF". Go check it out.

Also, why not just make a public notice of who you are and your political status? File a notarized document stating the facts and use case law to support it. Get it notarized and file it in the miscellaneous section at the county recorders.

Then when the question should arise you have proof of your claim of who you are and you have given public notice. Now it is up to them to prove that you are not a SLAVE. It is not your duty to testify against yourself to prove that you are not a slave. HHhhmm that sounds familiar doesn't it? (5th amendment)

Attacking Presumption of Debtor/Slave

I attached an ex parte declaratory judgment to my motion for common law docket and jury trial and petition for redress ( which included a motion to dismiss with prejudice.)

Sounds great but I screwed up in court with procedure and the judge blew it off. I have declared my status as sovereign with affidavit. However it demands that the judge make a determination as to my status before the court as sovereign or slave.

The judge cannot declare me a slave according to the constitution which only leaves sovreign as the alternative. It should paint the judge into a corner in writing if submitted right - and presented properly (my goof)

Since the judge ignored it I will file a writ of mandamus to force the determination.

I have another case coming up and I attached the same as part of my petition for redress. Hope we can be bettered prepared in court this time.

I am learning from others who have used this that the judges are ignoring them. They are all in various stages of writs and motions and appeals.

I am sure I should be able to use that fact in my motion to vacate as in the declaratory judgment it says:

Failure to make such ex parte declaratory judgment will be res judicata that the Petitioner is indeed "Sovereign not subject to fraudulent contracts."

It is supposed to help with paper trail (as we know they don't always put things in the record or even have a court recorder)

Of course it should end the case right then and there but you know how that goes.

If anyone else has any info on this and its effectiveness I would be greatly interested.

Don't be so sure that you screwed up in the court procedure, Sadie.

I'm starting to think that in most cases its their policy to blow it off the first go-around to see if you'll pursue it on appeal.
