So, I went to the Magistrate today to give them my cancelled contract offers (Ticket for driving without a license and no Insurance, two seperate tickets). At first she refused to give me her name, but then gave me her last name after I asked who her Bonding agent was. She said she was not bonded, but has a properly filed "Oath of Office" on public record. I was informed that I have "NO RIGHT" to cancel the tickets, and that they are "Tickets" not contract offers that I may cancel. I have written in Red Pen, diagonally across the face of both tickets "I hereby refuse your offer of contract", "Authorized Representative of with P.O.A." signed and dated. She was not amused. But told me she refuses to deal with the matter. When asked who I was, I spelled out the proper spelling of my name.



I then went to the Police station, where an Officer at the front desk would NOT give me his name after asking several times, but gave me a badge number. After reading the tickets he said he knew nothing about it, and would not take the do***ents (I had my copies). When I asked him who his bonding agent was he told me " I'm not dealing with this" and proceeded to completetly ignore me.



I guess now I have to send them to the Clerk of the Court by registered mail. I'm pretty sure I acted in good faith. So, If I was really mad about it, is any of that a failure to perform their duties, or obstruction of Justice??

[color=black][b]Something I learned from Irwin Schiff & Rory in the classic <U>Contractor's Licenses</U> thread was to do an FOIA or an informal request of their own job descriptions. Get job descriptions for everyone involved. This way you can prove a breach of duty (has to be statutory, common law, or contractual) in order to file suit. Or you could go for the void judgement as a defendant & kick one of the legs out from under the table of jurisdiction.

Well then this one is for you ICE, I'm all about punishing. I would like to go after the officers that stole my truck, illegally detained me, and whatever else I can. If they have guns is it armed robbery and extortion?

First of all, I wouldn't handle a ticket the same as you have described above. Remember, they claim that you "broke the law". There are certain procedures that must be followed in order to prosecute you. You must check your state statutes for the procedures that must be followed. (Hint: check out Jason Whitney's successes re traffic citations).



In regards to seizing your property and detaining you... there are other threads in which you will find comments on these issues. After reviewing, post further questions here. While you're at it... review the Badnarik videos and see what he thinks about the impounding of autos. You may gain some clues. (Like the fact that the public actors may be personally liable for damages and possible criminal charges).

I was going to go down to the JP and write up an information of the incident where I believe 2 individuals who were armed and impersonating police officers stole my truck. I asked for a Court Order and they did not have one, so they could not have been police officers. I guess I'll have to privately prosecute.



Or is that not a good route to go. The JP issues a summons based on the info you give him right? Then the burden of proof is on the 2 people impersonating police officers.
