It is so funny how much they claim to hate us. Just means that they interupt our threads not out of wanting to argue but out of dread for the flimsy flimflam house of cards legal theory they want to protect.

When Palani was saying "No, no, it is not mine or Wies's work,,, it is this other guys." My brother read it and said that it sounded like "Cult mentality."

I agree 110%. It seems those of us who post laws and such get attacked because the "paytriots" need to make themselves look better. I've been thinking that EXACT same thing Codee since I got banned.

Its like they spread this BS to intentionally harm others, to stir the pot. If anyone was a government agent, its people like that! The ones who keep the conflict at a maximum at all times.

They think flashy stupid legal theories will work, and that procedure and reading, acknowledging the law is wrong. Well, sorry, that how it is, even if it gets a little boring at times, just the way it is.

I got lot of people here Emailing me,,, they tell me that they appreciate the LAW being used in our arguments. Really people want what works and what is right. They offer a broken and a wrong.

There are others out there but they are haning out afraid of the power status quo of the old timers and never post.

The tide will be turning someday and some day people will gravitate tword the truth.

This is exactly the type of legal, educational information which is so necessary for all of us to learn and use. I would like to add useful, I hope, information to sections # 3 and #10.

#3 seems to combine information for both plaintiffs and defendants, without making it clear there is different information for both. If you are defending against a complaint and file an answer for "failure to state a claim for which relief can be given": you MUST state the legal reasons why this is so. Otherwise you have filed a naked motion. You can find the information you need in the "Practice Guide" for your state. If the plaintiff lawyer is sloppy and has not stated every element of the claim, you can file your MOTION TO DISMISS FOR FAILURE TO STATE A CLAIM FOR WHICH RELIEF CAN BE GRANTED. In your motion point out the missing element(s), and justify your statments with the appropriate case law cite(s); especially those about filing naked motions.

If you are the plaintiff you must file a complaint or petition for relief (different states use these terms interchangeably) which includes EVERY ELEMENT of the tort, breach of contract or other civil wrong. Otherwise you open yourself up to a "Motion to Dismiss for Failure to State a Claim for Relief". The information is in the "Practice Guide" for your state. But even when you file a perfect petition or complaint, the defense will usually file as an answer, a naked failure motion.

I know from personal experience filing this naked motion is the one used by lawyers to gain time: this is because they know no brother lawyer will ever call them on it by filing a motion for sanctions. As a pro se plaintiff, you hope the defense uses the naked motion tactic, and then you hammer them for it.

In my opinion the wonderful information provided by NDUSA is useless unless you are skilled at using the law library for legal research. In my opinion you should not even look at the forms, let alone try to use them, if you do not posess the background experience at legal thought and research. If you are not, get cracking and get the experience.
