failure to appear

hi all,

i was getting ready to go into court on a show cause hearing for contempt over a child support order out of another state.

i realized just now that the hearing was last week, not this week. i just recently (three weeks ago) was released after spending four months for contempt (one month for criminal, three months for civil).

i'm unsure what to do, call the court on the phone and explain or just show up and talk to the clerk.

any suggestions?

i'm worried i'll go to jail and lose my recently acquired jobs.

anyone awake this hour that can offer a suggestion?

In respond to your question: I will suggest go there and talk to the clerk, and explain your situation, probably they will reschedule you for another hearing.

perhaps, thank you for your reply. i just called and they said an arrest order has been issued. so i guess i have no choice but to go down there and try to explain myself?

they wouldn't halt the arrest. they said they couldn't, or wouldn't, do anything about the order. but their statutes say otherwise.

chapter 5a of the ncgs says that the judge presiding in that same district can hear it if the judge who made the order is unavailable. i wonder if i should call the judge who made the order up at his home. they told me to come back tomorrow and try to talk to him as he was gone for the day.

Yea, sure they can, it just a BS. Don't called the judge @ home unless the clerk or statue emphasized you can do so. Go back there tommorrow and talk to him or ask the clerk to assign you to another judge to hear your case.
