Online Vendor

A Friend of mine ordered a custom part for his car ($1000) pre-paid bc it was a custom part and the guy never sent the part. Lots of delays and excuses along the way, apologies, threatened bankruptcy (dont know what CH), etc. Several other ppl that he knows ordered parts too, paid upfront and never got parts.

We are all in Georgia and the vendor is in Kalifornia.

I thought about filing a lien of some type against the guy or his company, but that really doesnt force him to pay. Could file suit (remotely?) against him where he lives or works.

My friend and the other guys are willing to let it go bc they feel it will cost lots of $$ to pursue this guy and try to get their 1000 bucks back..

Any ideas would be appreciated..

First question, is how did you friend pay for the part? If he paid by credit card there is an easy answer.

If friend payed in cash, I am very much afraid he is screwed. it sounds like the vendor is cash poor if not legally broke, and will be filing bankruptcy fairly soon, and if that is the case there isn't much you can do since there will be no BR estate to be reimbursed out of. Same point for legal action, there has to be something to attach or there is no point in going to court.

One other option might be to go to your state's Attorney General's Office of Consumer Fraud, they might be able to help, and he might also contact the CA office of same, they mightt be able to put enough pressure on the vendor that he would repay your friend just to get the AG out of his hair.

forgot about this thread, thanks for the reply. To answer your question, I am not sure how he paid and it has been quite a while since he did, so there may not be a remedy there anyway..
