Reconsideration/Appeal Judges order

<P>Yesterday I appeared in Family&Court regarding past child support from my son's father.& He (father)&was never ordered to pay support until yesterday.& To make a long story short, my son is now 18 years old, both the father and I was&ordered at our last court appearence 11/'03 to&file&an Asset and Debt Statement and Income and Expense Statement along with most recent pay stubs.& I was also told to file an Affidavit supporting my request for past support, including how much&was my reasonable expenses per year for raising my son,&the father was told to provide a memorandum of law why Defendant Mother should not or should receive past child support from date of birth 9/85-6/03 graduation from high school.& We both did what we were asked to do.& When we got into court the Judge acknowleded reciept of my Affidavit Supporting Request for past child support, and that he read it.& The attorney present representing CSEA told the Judge that she also had my ADS and IES&Judge&than was told by father that he had his ADS and IES.& It was presented to the Judge, Judge looked at it and said "he didn't need it" because we are dealing with the past support not present.& It was handed back to baliff to give to father.& Judge than ordered father to pay $44,400.00 in past child support (which is okay with me), but this is the kicker.& At $100.00 per month, at this rate it will take father 37 years to pay this.& My son will be 55 years old by than and I could well be dead.& </P>
<P>Father was hesitate at excepting this total amount, the Judge than asked him to hand back to the Judge fathers Income and Expense Statement.&&Based on that the Judge brought to the attention of the court that father is now spending on his children at home (4) approximate $548.00 per child per month, and all he is ordering father to pay $100.00 per month for my son.& "He should be glad"& father quickly execpted the amount and condition.& Attorney for Child Spport Enforcement&Agency than asked both father and I to sign the order that the Judge just made.& Father signed it and I refused, giving the excuse that this all went too fast and I don't understand it all, I needed sometime to go home and discuse it with my husband.& (I thought by singing the forms I would be in agreement to judgement)&Attorney than said she would go ahead and file a motion on desision with the&court and I would be receiving a copy through the mail.& &With all that said and done here is my question... "H<U>ow can I get this judgement reconsidered/appeal?"</U>& Is this what I want to do?& </P>
<P>I am seeking testimonies of others who may have experienced this situation or similar.</P>
<P>I am not asking for legal advise.</P>
<P>I am a secured party, father is not.& I don't think it matters.</P>

Since you have posted a personal matter---please do not take this question personal, it is just a few questions to lead to some sort of dialogue.

Why did you do this after the minor has reached majority?

What is the purpose of going through all of that and then refusing?

Are you looking for a lump sum?

This does and doesn't make sense. If that makes any sense at all.

First of all I appreciate your reply, and now to answer your questions.&


It took 18 yrs. for this to get to court, because my son's father did not&acknowledge he fathered my son.& We were not married.&


I tried getting some sort of help and relationship for my son&from him earlier, but all leads in trying to locate him lead to dead ends.& He had moved within the year of my son's birth.


All I had to go on was his last known address, full name, date of birth, and last employer.& This information alone was not enough for me to locate him and pursue.& I went for assistance to help locating him but everyone asked for his SS#.


When my son was 12 years old we needed to get medical insurance for him and we went to get assistance (TANF) from the state because my husbands employer decided to terminate my son's coverage because their medical insurance would no longer cover step-children.&


So 3 years later the state charged me with absent parent (dead-beat)&and&went after me for&compansasion to repay this, and also they began the search for his biological father and this is how I got myself into this mess, with one case leading to another&where I am now.&


The purpose of me refusing to sign the doc. was because all I could see was 37 years (if it went as ordered $100.00 per month) before debt be cleared and my son would have received some financial help from his father.&


If possible one lump sum or a shorter period (a more resonable monthly payment).& A figure that could assist my son in futhering his education.&


I hope this has answered your questions.& I only refused signing the doc., if by not signing the doc.&shows that I refused the award of the court than again I am not aware of the law(s), and I'm trying to learn.

I appreciate your openess and patience to not explode at me. We all know that e-mails and written words usually do not convey inflection or tone.

Now, what I am about to say may or may not help you the way that you think it will so, here it goes.....

Kaimi, please take a step back out of the situation and look at it. I am not speaking of the personal matters. That will just cloud your judgement. Look at where your problems lies. The court. You went there for satisfaction and it took you and your son almost 18 years to get it.

So the challenge is not so much with the courts--the challenge lies within yourself. How can you get satifaction or remedy? Do you deserve what you seek? Are your hands clean before seeking remedy?

I believe once you establish the church within and do your studies, research and the like....I am sure you will find answers to your questions.

For example, do you believe there is lawful money in circulation today? This is not meant to insult you but, it is these basic things that we (redemptors) are about---eventually leads us to some sort of resolution to our battles with BB.

As Ice would state, you took a good first step by asking questions. But, to be frank with you--I don't know of too many folks that may answer your post because it borders on legal advice.

this is why I responded with this post. I believe that you can find a way to handle this situation through study, belief, critical reading, and learning where you are at in the matrix. you are the Queen---act like it.

And maybe your "so-called" enemy can really be your friend. And your friend may help you get the lump sum you need if you do your studies.

Again thank you, I do understand what you are conveying, I just needed confirmation to what you expressed. I truly feel victorious, and I believe the emotions within me took over and got the best of me.& I know what is necessary to continue to walk in the truth and I choose to do that.&


The battle is not within me, but I know where it is and I choose to leave it there and withdraw my position.& Having a relationship with my son and his father is more important.Besides&'Ohana means family in our Hawaiian culture and Family&takes care of one another.
