Right to Sue and be Sued

Capacity to Sue and be Sued is the real phrase...

Was this capacity delegated to the states by the people?

How about to the United States by the states?

If delegated to states where is this delegation found?

If delegated to the states then do I, one of the people still posses that capacity? Do I still posses my legislative capacities that were delegated? What about delegated judicial capacities? What about executive capacities?

If I have a capacity to sue and be sued can I relinquish that capacity?

If I relinquish that capacity can I still be sued?
