Be careful using a Notary for Protest. If you want to protest a foreign BoE are you the holder or the drawer? If you are the drawer a protest is not needed and the drawer cannot request a protest anyway. At least this is what we are finding in our research. If anyone has any other info please let myself or Vanton57 know. It is the resposibility of the payee to present the instrument for acceptance (payment) to the drawee and to issue a Notice of Dishonor to the drawer if it has been refused. If there is not NOD then there can be no prosecution, as this is the only evidence that can be used to hold the drawer liable. Remember, however, that this is for foreign BoE only and if it is domestic BoE (bank check), mere notice (NSF) is all that is needed. Whereas foreign bills must be protested inland bills need not be. The holder is the only one that can request a protest and must be a foreign bill to do so. If I have confused anyone let me know.
