Injunction / Relief

Suggestion: Anyone that is, or may be, looking at a possible foreclosure please check rule 65 of FRCP for Injunctions. This may assist you in staying in your home as you continue your battle.

Thanks for the post regarding Rule 65. In our case the only thing that would have stopped the foreclosure sale is a supersedeas bond for twice the amount of the judgment. Foreclosures, in Florida at least, are not handled in the same manner as other civil matters. An appeal does not stop the process unless the bond is posted. I guess they figure you will lose on apeal anyway so they make you put up the bond. As I have said before I have seen no wins when a foreclosure is involved. I know there is a way to handle this and it is just a matter of finding the solution. I am looking at something now, but will not share till I know it is worth sharing.

I was wondering if anyone had an example of the application for an injuction? This might be something useful for someone facing imminent threat of confiscation of paycheck by the employer on the advise of a letter from a tax agency.



There is a notation about not affecting the rules concerning employers or employees. Hmm...
