My recent court experience

WITHOUT PREJUDICE

The terse version:

Traveling in private capacity.
Pull into parking lot.
Man in Costume with gun and painted car with lights (BGT) pulls behind.

BGT: Where is your DL?
ME: Do I need one of those?
BGT: Since you were driving, you do.
ME: I dont have one.
BGT: You were driving
ME: I was traveling
BGT: You need an operators permit
ME: I dont have one.
BGT: I need to see your insurance and registration
ME: ok, hand him my insurance
BGT: *looking confused*
BGT: You need an operators permit
ME: I dont have one
BGT: What is your name?
ME: JOHN
BGT: What is your last name?
ME: I dont have one
BGT: What is your birth date?
ME: Are you acting in the capacity of a peace officer or policy enforcement?
BGT: *shocked look, no response*
BGT: *calls for backup*
BGT: Tell me your birth date
ME: Under duress?
BGT: Tell me
ME: under duress I will tell you anything. it is xxxxx
BGT: you need to prove who you are
ME: *thinking ****, i left my sovereign id @ home*
BGT: i need it
ME: Under duress I will show you my name
ME: *hands him MY (self made) license*
BGT: For my comfort and to talk in private, come sit in my car
ME: no thank you
BGT: It would be private
ME: no thank you, i am fine here
BGT: What is with the attitude
ME: have i dishonoured you? if I have, I apologize.
BGT: *gets in car, does up window*
ME: Leaning on car
BGT: *10 mins later, gets out*
BGT: You have an outstanding warrant from Calgary
ME: I dont understand
BGT: I am going to arrest you
ME: I dont understand and do not consent
BGT: *forcably grabs arm turns me around and cuffs me*
BGT: Get in my car
ME: under duress

* in car *

BGT: You are being arrested and could be charged with bla do you understand
ME: I do not understand and do not consent
BGT: *reads rights*, do you understand?
ME: i do not understand
BGT: *explains*, do you understand
ME: I do not understand
BGT: *more commentary about understanding and complying*
ME: I do not understand
BGT: your car is being towed
ME: not my car
BGT: WHAT?
ME: corporation owns it and in fact province of ab owns it
BGT: well too bad, i was going to cut you a break
*car gets seized*
BGT: *off to the station*
BGT: *talking on phone to buddy*: Ya, i have an interesting one

*get to station*
BGT: MR. DOE get out of the car
ME: *blank stare*
BGT: JOHN get out of the car
ME: oh, me. ok
BGT: no more of this silliness
ME: *no response*
BGT: so what is your name JOHN DOE?
ME: No, JOHN OF THE DOE FAMILY
BGT: ok, JOHN DOE DOE

*we go inside*
BGT: empty your pockets
ME: under duress i will comply
BGT: *pissed*
BGT: stand against the wall
ME: *silence*
BGT: Stand at the end of the counter
ME: *silence*
BGT: go in this room
ME: *silence*

*30 mins pass*

BGT: ok, come out
BGT: here are your papers *left them on counter*
BGT: put your glasses on
BGT: Here, I am serving you these papers
BGT: *slides them across, does not hand them*
BGT: You need to sign here saying that I served you
ME: ok, *sign by: /sig/ ucc 3-419, tcd*
BGT: what is that?
ME: that is always part of my signature
BGT: What does it mean?
ME: oh, just part of the UCC
BGT: ok, here are the other tickets
ME: ok
ME: I cant make out your name, will you write it down on this paper
BGT: NO, YOU have paper with my name on it
ME: ok, yes, I see here it is clear
BGT: *softened and scowls*
ME: ok

BGT: ok, no driving or commuting
ME: Sure, no driving

*cut loose*

There are now 5 pieces of paper in my possession. I know what I am going to do with them....

Court

ok, so we get to the place of business (PoB) about 10 minutes before scheduled sheep appointment. Man, the sheep were lined up out the door trying to reduce "their fines". Lol.

So we go inside and pick a seat. before I sit down, I see a sheriff. I walk over to him, cutting through the sheep, and hand him some papers and say this is for you. you have been served. So he starts reading the first page "private indemnity bond" out loud. I said, you should read these two pages here. (a writ commanding him to protect and defend me).

We go sit down. and wait. and wait. the sheep clear. we hear that the judge "has a flat tire" and is running behind schedule. (ya right).

So we go out side start talking, there is about five of us all told. After a while we go back inside after we discover they started.

We sit down, not all together. I sat right beside an "RCMP" (whatever that is) officer and behind four "peace officers" (whatever that is).

Between each person that came up to 'consent to a lessor fee', the persecutor turned around and looked at me. He did look somewhat disturbed. As we watched each sheep was asked 'do you waive reading of the charges?' and like good sheep 'i dont know', judge asked them 'do you know what you are charged with' sheep 'yup' judge 'ok so you dont need the charges read then ok, moving on'. So something REALLY strange happened. After they called all the 'consent to lessor' persons, the persecutor got up and said it would be a good time to take an intermission, yet not one person moved nor did one person say court was closed.

Then the persecutor requested (of the robe) that they find out who is here for trials. Usually they just work their way down the docket and put stuff to the end of the list. That is SoP. Anyway, so they call out the persons for trials, and good sheeple say yes, i am here or no and they did this 'not present, judge: warrant to issue, clerk: warrant issued, warrant endorsed? judge: endorsed'. did that like 3 or 4 times. remember, each time, the persecutor would turn around and look like he is scanning the court room and look right @ me. Then the persecutor said, lets go through the 'first appearances'. My person was there for a 'first (and only) appearance'. The judge 'polled' the courtroom, starting on the opposite side of the room as me.

Pointing to some guy - are you here for a matter? he was, he went up. he plead (begged) guilty. judge said pay the fine on the face of the ticket. need more time? no, pay now. judge said ok, you have till x and then it is one day (or so) in jail in default of payment.

So they pointed to a couple of men that were there to watch. Are you here for a matter? Nope (big grin). and kept moving around the room. The next PERSON to go up was told that first appearances were to be with the special prosecutor outside (in private). Imagine that. They wanted a private conversation.

So then she (judge) moves to the my side of the court. Anyone here for a matter, in green, blue or beige? I stood up and said I am here for a matter.

I walk up to the podium and say my sovereign name (SN) am here as authorized representative for the matters of *my person*.

judge: did you receive instructions from *person*?
me: yes, very clear instructions.
judge: is *person* in the court room today?
me: yes, he is here. (thinking to myself: in my pocket)
judge: do you have any identification?
me: yes, of course. *i start digging through my MOUNDS of paper*
persecutor (note this is the first and LAST time he spoke): cant you just give her a driver's license?
me: *look a persecutor* I am getting my document.
me: here ya go *hand notarized document to clerk*
judge: *reading document, looks down, looks over the top of the paper, looks down*
me: *silent*
judge: *hands to clerk* I will accept that, mark as exhibit A please.
NOTE: There was not one request for proof of agency....
judge: where do you reside (jurisdiction A) or (jurisdiction B)?
me: on the land known as Alberta, I am a member of a tribe
judge: I bet you go where you want
me: yes I do.
judge: there are three charges here, do you waive reading of them?
me: no *person* does not
judge: oh
me: You need to read the charges into the record, and certify them.
judge: What?
me: You need to read the charges into the record, and certify them.
persecutor assistant makes hand gesture to judge of "three" for three charges.
judge shakes her head and looks down.
judge: reads "seat belt" (not stated under any act mind you) and asks how *person* intends to plead
me: no plea at bar
judge: no plea at bar? *clerk with stunned look on her face*
me: no plea at bar.
judge: and what did person tell you was going to happen when you said that?
me: not sure.
judge: what do you expect to happen?
me: the charges are to be stood down.
judge: ok, so seat belt. *person* must pay clerk of the court. and a warrant to issue.
me: No thank you.
judge: a warrent to issue
me: I refuse your offer
judge: it was not an offer - chuckling under her breath.
judge: we are done.
me: ok

Comments:
There was no amount stipulated for the 'offense'.
There was no timeline stipulated to pay the 'offense'.
There was no immediate grab of the man.
The warrant was not issued nor endorsed.
The 'man' carrying a gun wearing a costume with letters "RCMP?" who tendered original offers was NOT present.

Now what you are NOT aware of is the HUGE amount of administrative remedy that was executed behind the scenes and ready to be tendered as more exhibits.

So a third party went to the court to inspect the files and was prevented from doing so. However the clerk read him and wrote notes on a search paper that *person* was convicted in absence on two items and a warrant was issued.

Funny thing, the piece of paper for the person that was sent by clerk of the court indicated that *person* was convicted in absence on a DIFFERENT day (one week earlier) and that there is a fine payable.

Anyway, thought you guys would enjoy a good story backed by three men on the land willing to endorse an affidavit under full commercial liability....
