Because the Supreme court has already declared that the parents have a vested property interest in the children, and the taking of that property would require an in rem process. Even in that in rem process, the state is requirred to show that the state has an overwhelming interest in the welfare of the children. Thus the many coined phrases relating to the children as being a "precious resource", as was declared here in Florida by the legislature. Also the Parens Patriae doctrine formulates a custody dispute between the 'natural parents' and the 'substitute parent'. The very term "custody" should give a clear cut explanation of what is really going on. And the other phrase "possession is 9/10ths of the law".
