Talking Reno Municipal Court

Hey there Everybody!!

Well I went for my arraignment this morning. The whole expierence was amazing.

We stood in line in the court room and the little Reno Marshall asked for
your name and then pulled the citation from the pile he had and asked "How
are you going to plead". I thought this was odd because normally the judge will ask you that. So after you tell him how you are going to plead he tells you where to sit. If you are intending to plead Not Guilty you sit in this area, if you plead guilty you sit in a different area.

The Reno Marshall (Bailiff) asked: How are you pleading.

I said: I shall remain mute.

He said: You have three choices Guilty , Not Guilty or No Contest.

I said: I shall reamin mute.

He said "OK Not Guilty" sit over there and you can seethe city attorney in a few minutes. Before I sat down

He said "Do you have your DL and proof of insurance?

I said: Its in the car.

He said: you have some time to go get it.

I said: That's ok.

Then they showed the video about you constitutional rights.

After word the little marshall says "Does everyone understand their
consittutional rights as explained on the video?

The crowd answers in unison YES! And one voice says NO. (Guess who)

So the little marshall looks at me (and so does everyone else)!!

I said: I couldn't hear it. You and the other marshall were carring on business and talking and I couldn't hear it.

He says: I'll get you a written copy.

So then I am told to go stand in the hall until the City Attorney Calls me.

I go into the office and she askes me if I am Katherine Elizabeth Snedigar?
And I pause and look at her...

She says: It's a yes or no question.

I said: I am first letter capital the rest lowe case Katherine Elizabeth Snedigar.

She says: do you have insurance and did I have it at the time of the stop and do I have a DL?

I said: yes it's in the car.

She says: You can go that now and we can clear up those two charges and all that will be left is the seatbelt violation.

I said: That's ok.

Now, here comes the marshall with a copy of the Constitutional rights and the attorney says sign here and here so I did and then she takes the paper
away!! I get herded back into the court room where they are giving me a
court date and I sign another paper for the court date. The I ask a
different marshall if I get a copy of my constitutional rights. So he made
me a copy. The Bailiff's/Marshalls were friendly and so was I. Smiled, polite

I signed everything
without prejudice

SOOOOOOO I never saw the judge!!!!!! And Trial is set for Dec 15.

Oh and when I was leaving the court house (Reno Municipal Court) there was a dark blue/green or black Lincoln Town car parked watching everyone come out. I had an idea they were going to harrass me. So I go to where my car is parked and pull out to a red light and sure enough they are right behind me. So I am a little nervous and I just drive along when the light changes and they follow me for a half mile or so then fall way back for about 1/4 mile then they come right up on me (so now I am a little nervous) and then they go the other way!!! HMMMMMMMM. Still no license plates and registration.

So what do ya think??

NICE!

I had to do some diggin to re-brief myself, and believe I found it here.

So, let me get this straight... you have an active DL, and insurance... but are driving a car with no registration or plates? Amazing !

It is my understanding, you had to be 'all the way in', or 'all the way out'. How you can exercise the priviledge of 'driving', without the usual 'flags on your vessel', I find quite curious...

I would find the latest copies of all of the Nevada Rules of Procedure, Civil, Criminal, Traffic, Local, Evidence, ect... and see if they have been updated to allow this.. I'm shocked you never spoke to a judge... but then, they'll do anything to confuse, and intimidate... You should do some digging in this area... I am sure something is amiss...

I do know, Nevada is one of the 5 or 6 states, that have active lawful 'original jurisdiction' hiarchies in place ! You are lucky to be so close. They are, no doubt, responsible for the williingness of the court to ignore the lack of plates, ect. You can get more info at http://nevadacommonlawvenue.com/

Hey Akira!! Thanks for the support, I really appreciate it.

Here is a little list of things to do my friend signed me up for.

"Kitchie -- You did well. It appears that Reno Justice Court is also deeming it viable to violate the law and their oaths of office. What you need to do next is to find out what judge is going to hear your case and get a copy of his oath of office. You want to do the same for the city attorney, the Reno Marshall and the judge who was on duty that day (or all of them). This will be necessary to set up the challenge to them and to bring criminal charges against all of them with the State Attorney General, the US Attorney and the FBI. So you will need to get the mailing addresses of these people and a copy of their required complaint formats. I also want you to check to see whether the judges are members of the Nevada State Bar and get their Bar Numbers. I also want you to gather up the Justice Court Rules set forth in the Nevada Revised Statutes and the NRS for criminal proceedings -- specifically the demands set forth for pre-trial procedures -- i.e. first appearance and
arraignment. You need a copy of any paperwork used in your case and you will find this by going into the court and asking to see your case file. Get copies of anything you do not have, including but not limited to the docket sheet."

I'm also in Nevada and planning a similiar stunt, dl and insurance but nothing else.

The deal is that the contract is when you sign up for your drivers license. If you sign it reserving your rights, then how can they tie the "person" in the statutes to you? That is a presumed contract and it doesn't apply since you reserve your rights. Unless it specifically says so in the contract, then united states citizen and resident mean nothing other than what u want it to mean.

This is my understanding.

Hey Sixthbeast

I believe you are correct. However, my car says it's private not for hire with my UCCFS # right on it. So they never have probable cause to cite me because my car is exempt. Now if I am driving on the sidewalk then they can talk to the representative of the fiction.

When you go to court pay particular attention to the process and take notes on what happened. Get the name of the marshall/bailiff the city attorney and the judge. Answer as little as possible. We can keep in touch and do our cases the same way. See, now its about procedure and not what the ticket says.

Stand mute and let the marshall/bailiff become your attorney after he makes a plea for you. See what's happening??

I really want to serve him with something that says that he is now representing me since he made a legal determination and reported that I was pleading not guilty when in fact I remain mute.

Maybe if you can make the same thing happen we can just sue together. And maybe just maybe Terry Kaiser Cooper will want to handle this!!!!!

sounds good Kitchie, i'll let u know when they come after me. I haven't had any issues yet, but I expect that the first cop who pulls me over will get me in the courts.

Hey There Everyone!!

Hope you all had way too much fun on turkey day!!

On Wednesday I went to the court to get a certified copy of the stuff in my file. So after I requested my file the supervisor came out and handed me a little sticky note that said "Discovery City Attorney". And she said you have to go to the City Attorney's office for you file it's not here.

So I go to the City Attorney's office and speak with the receptionist. I also have two witensses with me. And I sayd I am ... and I would like to see my file. And in a very arrogant and rude tode she says"Did you get a letter for discovery? And I said no I have not received anything. And she says "you can't see your file without a letter for discovery. I don't even think it's here yet." I say well I was in court a week ago today and I just came from the court and they said the file is here. She says " Well I don't think the secretary is here" and begins to pick up the phone. I say Well trial is in two weeks and I need time to prepare and I need to see my file. She picks up the phone and talks to someone all the time acting like who allowed this person to come in here! Then this other woman comes out and says the secretary isn't here. I don't think anything is in it except for the citation and you have a copy of that. I say Oh there is more in there than that like the notes of the city Attorney and the officer etc. The the rude _itch says you'll have to come back Monday.

The files are not to be removed from the court. They are court property not city attorney property.

Then we went down stairs to get oath of office for the judge and the Cheif Deputy Attorney. Boy I'll be they get word about that real fast.

So there are a couple of affidavits that are getting written as to what happened at the court and the CA's office.

Hey There are you freedom lovers!!

Well my friend helped me write a great Notice and demand for Discovery that was 13 pages and is going to cause some real problems for the Marshall and the Judge and the city attorney.

On Wed 12/8/04 I went to get my discovery packet from the CA (City Attorney). Now my traffic case is being held in Reno Municipal Court and they can ONLY hear civil matters with a dollar amount of not mor than $2,500.00. They have my case in the criminal arena. I'll ask the judge about that tomorrow in court. LOL

So the CA drops this "packet off on the table and says sign here. I said not without reviewing it first. And then I asked for another copy of the Discovery letter because the one I received in the mail had some of the words missing. So she huffs off to get me another copy. When she comes back with it she tried to hand me the same bad copy and I said"I alsrady have one like that could I please have one with all the words?"

So she huffs off again and I say I would like to compare this packet with your packet. so she grabs my copy and starts going thru it page by page. THe only problem is I can't see the pages! So I decided this is crap and let her do her thing.

Then I signed the receipt for the packet and I was writing "Without prejudice" and she walks past me and see me writing and says under her breath without prejudice ok. It was like she was thinking but I know how to deal with this crap. Then she asked me if I was going to call any witensses.

This was the way fun part. I acted like I was trying to think what I should do and I said well (pause) the Officer of course and, uh I guess the Marshall who entered the plea for me. Now when I said this she had her back to me and was walking away from me. She immediately turned around so fast that my friend and I thought she might suffer from whip lash, and she said "The marshall entered the plea?" The tone (to use one of Bush's favorite lines) was shock and awe! I said yes that's right the Marshall entered the plea for me and my friend said yup the marshall entered her plea. And a couple of minutes later poooof!! She evaporated!! Gone no sign of her. I was very much in control and I waited until I was outside before I started laughing a lot.

So today I took to the court and the CA a Notice and Demand for discovery in which I say what I want for discovery and then list my arguments with a supporting affidavid. I also filed a motion for extention of time with an affidavit for revoking my signature after I discovered that it had been placed on a document whic was never been presented to me for signature.

I hit the judge right off in my argument with the NRS that describes how to conduct an arraignment. Then I reminded the judge of Canon 1 of Nevada Code of Judicial Conduct. The first sentence says "A judge shall uphold the integrity and independence of the judiciary."

In my wish list for discovery I ask for "The name badge number and other identification numbers of the marshall who entered a plea of not guilty for defendant."

Then in the arguments I give em the Statute for the duties of the baliff. You all may not believe this but entering a plea for people off the street is NOT in his job discription. I thought it would be irresponsible of me not to also provide the statute for practicing law without a bar card. Do you agree?

I politely said in my argument that I am challanging juristiction and that the "Federal courts will have to determine whether the acts by the judge of the court is a judicial act." And then I mention what deprives a court of subject matter juristiction. Examples in my case are Fraud, denial of due process, lack of statutory or common-law authority, Oath of Office, Lack of competent witness, Forgery, violation of constitutional rights.

Then come the authorities Lots of cornforth, some include that willfull misconduct in office or willful and persistant failure to perform his official duties by a judge of the unites states is inconsistant with the good behavior required by article III an dshall be cause for removal.

Well tomorrow I have court and I guess I am going to see how they react to my stuff.

Wish me well and try to picture them begging for my forgiveness if they promise never ever to bother me again LOLOL ROFLMA LOL, Like that would happen!!!

Well court was very interesting. I will post the story over in success!!! Yes that's right I said SUCCESS. And I would like to say here that it is VERY IMPORTANT that you take witnesses. The more the merrier. Also have them bring a notepad. It doesn't matter if they take notes or draw pictures or make grocery lists...the judge notices people writing and he doesn't like it.

YYYYEEEEEEEEEEEEEEEEEE HAW!!!!!!!
