I think they would be wise to heed your warning, because you sound like you'll take them down a notch or two if they really piss you off.

I REALLY want to know what their response is! It will sound nasty, but the Ammo to hang them will be in their response.

The people that keep coming after you can now be charged with Public Nuisance by going down to a JP with your evidence.

Dalrex was with me when I hand delivered my response to their response, to my cancellation ( hahaha ), and I can tell you they were NOT happy. I gave them a warning of what would happen if they continued harassing me.

I will keep you informed. I should be getting my book wednesday from mark stevens, got confirmation from him today. so you know what I'll be doing the next few weeks. studying and role playing.

How can you not have a Justice of the Peace? There has to be a bunch of them, the police must file these charges in the same manner, call you State Courthouse, and ask where you can contact a JP. Or, go ask the Magistrates at the State Courthouse. If someone told you there are none, they were lying, people use JP's all the time to get married even.

EnSabahNur hasn't received anything back yet from them in response to the last letter he sent... nor has he received any more photo radar tickets etc.

We've decided it's possible b/c of a few things:

1) They can't write back to DXXX X CXXXXXXX (ALL CAPS) whom the tickets are issued to b/c they would be charged w/ Public Nuisance and therefore they have also removed him from the computer system issuing these BS tickets.

2) They've decided to wait as long as they possibly can and actually do some reasearch into the matter w/ their legal dept. before responding since the first letter they sent off was a joke.

It could be something else on top of that but either way we've slowly but surely getting to the bottom of more and more that we're obviously supposed to know. Squirrel, with your help down in the States, we'll soon have a great format for everyone to go by.

I have one more problem to deal with, this all started when I was pulled over for rolling thru a stop sign in the middle of the night when no one else was on the road, "except the roaming revenue officer" in minneapolis, did'nt give my name to the him, off to jail I went. after they forced fingerprint me they found they had the surity for the fiction which has a cancled license and a warrant in sherburne county " which I hopefully took care of yesterday " they stole my fathers car and are holding it hostage till the outcome of the case. I have a scheduled appearance for the 12th of January in hennepin county. It has been over two weeks since I recieved the court papers for appearance, and my understanding is that you have to cancle them within 72 hours. wondering what I should do about that.

The 72 hours is only for a contract you have willingly entered into. You are making the case that you never willingly entered into it, so it is NOT binding.

Also, before the outcome, and as immediately as possible...go file charges for theft against the individual who stole your vehicle. Write up an Affidavit of the facts. DO NOT call him an Officer...ONLY use his real name. He cannot hide behind statutes, unless you refer to him as an Officer, since the legal fiction "Police Officer" does have that right, keep it in the common law arena. If he tries to defend himself saying he is a Police Officer and had every right, well, that is his opinion...but it is yours that he stole your vehicle since you are the damaged party.

I would include, illegal arrest, kidnapping, theft, assault, and illegal confinement just to name a few.

Please forgive my ignorance. how would I make the case that I did'nt enter into it willingly ?

Should I write that on the court appearance papers ? along with the refuse to contract ? and send them back ?

would'nt bringing charges against him in their court system keep it in their arena ?

Have you seen the contract?
Did you sign it?
Did you understand the terms?
Did you have it explained to you, or did you have full disclosure?

If you never contest it, it stands as you accepting it by aquiescense. If you contest the existence of a contract, they must prove there is one...it is not you who must prove there is not one.

People NEVER argue this however. That's why I said to ask the ourt if you entered into a contract with it...if it goes that far after the first 3 questions. If they say "No, there is no contract." say thank-you and leave.

If they say there is one, ask to see it, and have the terms explained to you....or full disclosure.

EnsabahNur, Today is Friday, since I was arrested, and I did go to court once, but was late, so judge rescheduled it for 12-27, this monday, I'll have to go to court and try this stuff about the contract. What if the judge argues and says what are you talking about? That's a legal opinion? I got a letter from the "deputy court clerk" stating if I didn't show, there would be a warrant. But I will go and try these questions first and see what happens.

LOL, well, I would try the questions, NOT rising, and sure...by all means give the contract right to him and tell him you refuse the "Offer of Contract", as you believe you have been decieved and were never explained the terms of the contract. If you are going to do that, simply give it to him, state that, then LEAVE...Do NOT get into legal opinion 'discussions" with these people or they will get you.

Refute the existence of any contracts that they cannot produce to prove they exist. My "Introduction Card" that I carry explains all this, I cannot wait to show it in court.

Have you read the "Questions to ask judges", or "Questions for Court" thread? I cannot remember the exact name, but it is from a few weeks ago only and addresses just this.

I wish you success, and have a good time with it. Challenge authority, make sure you let them know you are there as yourself, and are there suijuris. Do nothing they tell you to, simply tell them what you have to say and leave. If you stay, or get into debates with them you are acknowledging their authority.....since why would you be debating with people who have no authority over you?

I would not even call him Judge, or your Honor.

Call him 'Captain' and see what his reaction is if you really want to have fun. Then tell him you are NOT one of his crew, and he has no authority over you.

I loved this line from the other thread when asked why he did not rise "I have only one master, and it obviously is not you."

And I want to hear all about it. Don't give an inch...and don't hesitate...make your presence KNOWN! And demand...don't ask!
