Now if we could just demand that they "remove" that gold fringed flag from the courtroom, because as long as it remains, we're all in the "british admiralty maritime venue" with nobody getting a fair trial unless they have knowledge aforehand of their sneaky tactics.

Regarding not making a plea, the Black Robed STATANIST entered a plea in without even telling me. I walked up to the clerk window after he denied my motions & they tried to get me to sign something saying I plead Not Guilty.

The best thing if you ever wind up in court is to emphasize that you don't understand the proceedings or charges & that you have to ask a few questions before you plea.

That's the point where you get all Marc Stevens on dey asss.

To be honest with you, I don't think I would sit there and let them go through their little proceedings and wait like a dog until I am called...I would stand up immediately and demand to know the meaning of what is going on here.

Do not give them a chance to start making decisions for you. Well see if my attitude on that changes after court on monday with dalrex. You cannot be held in contempt for doing something once.....and I don't plan on doing anything twice........ ;D

As you say, if you have been convicted by "default", then there should be no need for you to respond to anything, therefore you have not yet been convicted by default.

I am curious as to exactly what you are being asked to respond to, and what kind of respose is being requested of you?

My guess, is that the paper work (or contract?) is stating that if you do not contest the default conviction by the due date, then you'll of accepted it.

I also assume that the paper work has spelled out for you exactly how you must go about contesting the default conviction. If my guesses are correct, then what you have done is to effectively contested the default conviction prior to the due date, but not according to the rules that have been supplied to you.

The next move may be to claim that since you did not respond according to "proper procedure", that the default convictions are therefore made final, however that would be a very weak stance to take, esp considering that your respose is to say that your are being defrauded and that the charges against you (the tickets) are fraudulant. If there is a proper procedure for a response, then it would have to made a law, otherwise you'd have no reason to abide by an arbitrary process.

I imagine someone on the other side of your letters will be working late at night reading the fine print, because he or she may be wondering what to do with someone who simply refuses to recognize not only the default conviction, but also the entire process, by claiming that the tickets are frudulant in nature.

What happens next should be very interesting.

Isn't it amazing that when you truly read the entire "presentment" there is always an offer -- I have been trying to be very diligent of late looking for those offers in every piece of paper that crosses my desk -- when most people think these things are cut and dried, is it not wonderful that we are aware? Now we jsut have to perfect the proper procedure to return their offer with one of our own -- not just accept, but re-contract.

I think that is what I have done actually, because I have fined the Director of the court more than $60,000.00. And she was warned not to contact me again. I did NOT address the court, but her personally, so I will send her the bill, have her charged also for Public Nuisance, and then send her a Notice of Default after 30 days followed by a Certificate of Dishonor. Then I will move in a start liening her property, informing the CRA's, and go after bank accounts. This is of course after I multiply the damages by 10x to $600,000.00 for defaulting and dishonoring the debt to me.

I believe I'm supposed to go after her bonding also, ..... non?

It will be a good trial run for ruining the lives of several Canada Revenue *******s next.
