Thoughts on this tactic of attack on Rogue Judges
All,
I was doing some course work on my government course and I just thought of something. I wanted to poll this forum on this idea....
If you were in court and got ran over by a Judge that you knew ignored your documents...how would you feel about contacting one or all of the judicial committee members of your state legislature and notifying them of the misconduct? Since they are the committee for Judicial conduct.
For example, the judge ignored your judicial notice or supporting case law or evidence or neglect of court procedure.
I thought this might be a better avenue instead of an appeal. Because if he committee can find wrongdoing--I think those investigative findings would be more than enough ammo to go after them in their personal capacity.
Please keep in mind that I did not think this all the way through. So there may be something not sound, this is why I am polling this thought/tactic.
Besides, it keeps you in honor and gives a state representative a bone to chew in an election year.

Speaking of misconduct --
The one thing to remember is that a court reporter does nothing more than record words. It is important that any unusual actions of the judge be noted . . . and there is only one way to do this -- you must point them out.
"Your honor, why are you raising your voice ? "
"There is no need to scream, your honor, I can hear you just fine."
Be quick on your feet . . . and note anything that isn't right. Get it on the record.

The judge would be acting under the color of law and also committing public nuisance. I think it would be best to go after him in his legal capacity ASAP!!! I also think it would be an okay idea to notify the other judges of what's about to happen to their fellow person.

Yes,
I remember those things both of you stated. But what do you think about getting a committee hearing or investigation going?
I did not research teh nuances of this but, I think this is a very good strategy. What say you about this paticular avenue?

Hi All,
Her in the great state of Nevada the judges are threatened by the DA to find a certain way on (specifically) zoning cases. Judge Jack Schradder said in a court case on the record "I don't care what the law says do what they tell you" and he was pointing at the county code enforcer!!
In another cas the judge was "advised to find in favor of the county and he did NOT do what they said and found in favor of the property owner. On the record the County code enforcer said we're comming after you next to the judge!!! He happily reported to the FBI. So far Nothing.

Aren't you just asking the wolves to discipline one of their own wolves? So far, I'm not seeing the point of your proposal. Marc Stevens says he's done similar things to no avail. He just gets ignored. Maybe I'm misunderstanding what you are saying.

there is nothing to misunderstand. Judicial misconduct should be reported to the judicial committee of the state's legislature.
Now if it not feasible for what ever reason, please state so. Or if you find this interesting, please state so.
I don't know Marc Stevens but I do know this, just because it did not work for one person--does not mean it does not work.
I'm just presenting an idea that struck me, and I did not think it through because I want it to be raw and critiqued, that's all.

Jerseee, I recently rean across a case here that shows the only way (in my mind) that they will get discipline.
A judge here recently got a DUI, the publicity was why they removed him.
The only way to clean the house is to shine the light on it first.
Ice may be right.
It may very well be time to start buying advertising space in the newspaper, or start printing a newspaper just about dirty judges.
They are in bed together, and they ain't gonna punish, unless it LOOKS like the right thing to do.
It's all illusion. That's why I am so glad I had a court reporter at my hearing. They can't deny that they railroaded me, and I will gladly show it to everyone I can.
