Justice of the Peace

does anyone have any information on how a justice of the peace is supposed to be different than a regular judge? The reason for the question is it seems they can sign documents that a regular magistrate judge will not do for you, like a declaratory judgment.

I know, at least in some states, the justice of the peace is an "elected" position, as opposed to judges, who are "appointed" by their state's commander in chief.

Also, we had a situation in which it became an issue that a justice of the peace could not witness an affidavit, claiming that she was a justice of the peace, but not a "notary". It is interesting to note that this individual was also a court clerk.

This raises a very interesting point in the area of an adjucator being impartial & independent. The unfortunate part is that they canstill be threatened. Maybe if Sovereigns can appoint themselves as a justice of the peace, but the problem is that we would have to enforce our orders w/ armed men to take stuff.

You would have to check your state constitution. Justice and judges are appointed in some states, elected in others and different courts have different duties.
