I Give Up!
Well, the judge signed off on the order to lift the federal bankruptcy stay for the mortgage company this past Friday. They have not obtained a Writ of Possession from the county court as of yet (Tuesday evening).
I have not received the bankruptcy order yet to know exactly what's in it and why the federal stay was lifted.
This is so over my head now I don't know what else to do. Once again, I'm up against time with no clear answers. It seems "one" of my biggest problems has been that, all the fighting that I'm doing has come "after" my house was already foreclosed. So basically, someone told me that there is no true protection under bankruptcy for me because the mortgage company already owns the house.
I'm attempting to either file a motion for reconsideration or an appeal, just to buy some time but looks like the trustee is going to object to my confirmation of the bankruptcy anyway this Thursday because obviously I haven't made any payments into the bankruptcy and because I haven't finished paying for the initial filing fee which I had set up in installment payments, to buy more time and because I didn't have the initial cash.
Does anyone know of a way to get around the filing fees of $255 for filing the bankruptcy appeal? I was going to try and use a "Paupers Affidavit" but was informed by the bankruptcy clerk that I could not use it and the appeal would be immediately dismissed by the judge if it was not paid for. I'm thinking of filing the Appeal under Federal District Court which is an option under 28 U.S.C 158(a) or 28 U.S.C 158(c) and I think I could possibly use the Paupers Affidavit in District Court. I'm not even sure if a motion to lift the stay order can be appealed anyway?
Looks like I'm packing my bags in the next 24-48hrs unless the Heavens open up and drop a miracle into my lap.
