Power Plant in Your Backyard

We live outside a town, where the Mayor went to an electric utility company and told them that there was some land for sale and that the people of the town would be all for the power company, Aquila, building a power plant outside of town. Aquila purchased 74 acres, zoned agricutural, surrounded by 3 farms and several acreage subdivisions. The DNR held a meeting at the people request (packed room) and listened to the state that they did not want the power plant. We had one newspaper company, and Fox4 televised the meeting. They edited any of the expert testimony out of the news.

A petition, to stop Aquila was signed by over 250 people. An attorney was hired in October of 2004 by the concern we the people. The County sued Aquila. The case was heard by the County in January 2005 and told Aquila to cease and desist and if they wished to appeal that a bond needed to be posted. The bond was set at $350,000.00. The bond should have been for at least the price of the power plant. Aquila is still building this power plant and have stated that they need the plant on line by June of 2005, They have been working 7 days a week non stop. We live 3/4 of a mile from the plant and the noise from that site is unbearable. Today they brought in the first turbine on a trailer and it literally shook our house.

This single cycle gas plant is being built with outdated technology and poorly devised plans. Again government for the people and by the people is allowing big business to do what they want, even though it will be an added health risk for the people. Don't attorneys want to make a name for themselves and stop the wrongs that are being done to a community? Am I living in a fantasy land?

Most of the americans today do not understand one simple consept:
THEY have been incorporated in the communities where THEY live.
You are no longer sovereign men/women unless you raise an objection.
Whatever you call people's government,is no longer there,instead you
have a Corporate govern-ment.
Members of one Corporation are not allowed to complain or to sue the
Boss Corp.,without permission.
The Corp Mafia is very well trained in confusing <the people>.

One more thing to keep in mind,a Corporation can act under the guise
of the Patriot Act,in and for <the public interest>.

Am I living in a fantasy land?

No, not at all. You have a wonderful grasp of reality. Same thing here in little town of Vinton, VA, back in early 80s. Long-story, short version:

Town meeting to discuss a new "apartment" complex that was to be built off of Pollard Ave (i.e., main street. BTW, our "main street" runs exactly 4 blocks. Right. "Big" town....)

Now, at the time, we were living right next to the lot where this "apartment complex" was to be built. We went to the meeting. Hundreds three. ONLY three people favored the thing: Owners of the property (duh), developers (duh), and lawyers representing both (duh). All else? HELL NO!

Meeting ends. Council says: "The people have spoken and there will be no apartment complex in our town."

Lisa (my wife) and I walked out. Me: "In two weeks signs will be up talking about the new construction. Wait and see...."

Almost two weeks to the day, the sign was up.

Did they build an "apartment complex?" Well, no. They built an "efficiency inn."

Backstabing, two-faced, lying, white-man-speak-with-forked-tongue bastards.

Been that way forever. Ain't gonna change.

Any Ideas

Anyone have any ideas as to ways to stop this electric utility? Is there a way to make them libel for building a power plant with no rezoning? The power plant was started without permits from the DNR or the county. Aquila stated that they did not need permits. The utility company has a hired security guard who will follow and intimadate you if you drive down the road. We drove down the road slowly, to see if they had stopped building after the court ordered Aquila to stop and desist. The security guard came flying up past us and then followed us, definitely trying to intimadate. The noise level will be above what is considered safe for the residence living across the road. The stacks are to 55 ft tall, when stacks a usually around 100 to 150 ft tall. Our subdivision is 3/4 of a mile north and east of the power plant. The winds come from the southwest and on days when there is little to no wind the emissions will hover over our neighbor. We will take any advise or help that anyone is willing to offer. Thanks!

Are bonds helpful here

If the worse case senerio happens here, the courts rule in favor of big business, and the fact that the Mayor brought about this situtation, could a bond involvement help in this case?

Need Help!

This situtation may not be in your backyard at the present, but it could happen to you. The pollution in the US is at an all time high. If the powers that be can bring down your immune system and then one of these rare flues come around, or your body comes down with cancer, you can not fight it. I read an article in Life Magazine 1977, warning about pharmaceutical companies and the dangers that could come about from us chemical medicine as apposed to Natural Cures.

We need answers here before it happens to you.

There was a public hearing with the Missouri Public Service Commission. The meeting was to be held from 6:00 - 9:00 P.M. - it actually was not over until 10:15 P.M. Guess who the first dozen or so witness were? They were all contractors and/or people who have or will benefit from Aquila through business deals. Aquila is still building the power plant, when there is no need of additional electricity for the people until the year 2017. An article was read by one of the people who live near the plant which stated that the US has excess power that will last into the year 2017. So why the peaking plant in a subdivision? The meeting revealed some very underhanded practices and definitely showed that there was no need for the plant. This meeting was a hearing for the people who reside in the area and Aquila's hearing is March 28, 2005 in Jefferson City, MO. Why was Aquila there at the hearing for the people? The commissioners stated that the hearing was for the people to express their concerns and needs.

One of the major questions was why, Aquila, when ordered by the court "cease and desist", has not been held accountable to the law. If it were you or me, we would be in jail. This is an illegal practice that is starting to show up in rural areas. The practice is to throw up cheap plants before the clean air regulations tighten. They have hired security guards that have been patroling the neighborhoods and shining spot lights on the neighborhood homes. People watch your neighborhoods you could be next.

With the failure to follow the voice, reasoning and opinions of the people, the Aquila folks have now become "the Enemy" as if they were not before.

First, find out who contacted them in either a PUBLIC or PRIVATE Capacity. Prove it with documentation and then go after their bond. Get them out of office for the debacle, then go after them with criminal charges for example: of aiding and abetting a criminal conspiracy.

Second (A), fight fire with fire. Talk to neighbors and see who will be willing to place spotlights on their private property and shine say infrared spotlights on the construction site.

Second (B), call in one of the many "tree hugger" groups and give them the lead. They like to stick their nose in where their not welcome at times, and rumor has it the are funded by NGOs for the most part. If they refuse, publish the fact that they were too chicken to proceed, and ask why publicly.

Third, get video of the security personnel in uniform and in their company vehicles or on foot shining the lights on private residence, the group up and sue the company that employs them for: lack of sleep leading to mental, emotional and physical distress, duress, and anguish.

The information on the security company bond is public knowledge, in the public domain, and must be filed wherever the outfit has lic to operate. If you go after them in the corporate world, make the suit for 10X the bond.

Do this AFTER you have sent a letter demanding a cease and desist w/the shining of the light onto private property without legal cause. This is pure harrasment, and must not be tolerated.

Just a few ideas. Hope you can use some of them. Everyone else, feel free to jump on what I've written, tear it apart, fine tune it, or whatever. We must all hang together, or we will surely hang seperatly.

Thanks for the comments. The neighbors have united together. We just completed a public hearing with Missouri Public Service Commission and had around 50 people testify. The issues covered were health, noise, ZONING and property values. We learned in this meeting that land purchased in another city for this power plant is still owned by Aquila. This in turn leads us to ponder, if Aquila gets approval, then they can build these power plants all over our counties. If they get away with it in the MidWest, does this set precedence for other states?

Monday, March 28, 2005, there will be a hearing, where Aquila will get to testify why they think they are beyond the law.

The hearing took place last week. We are now told that it could take up to 2 month for the court to rule. In the meantime, Aquila plans on having the plant up and running in 2 months. Something smell fishy here?
