Attorney's lost in civil now filed a Private Criminal Compliant

Well I suppose I am going to find out the what kind of food they serve as well Mr. Bowman. The attorney for the Bank has lost in both civil cases he has filed against me and now he is persuing a private civil complaint that holds a felony charge for 3.5 to 5 years. I suppose since they couldn't win in civil court it pissed them off enough to want to get me in jail I am being charged with Title 18 statue 3927A in Pennsylvania the end of the month. I never sold the car they are talking about but I assume for some reason they think I have gained from all of this. Anyone have any ideas. I still have the car and just wouldn't give it back and so far didn't have to since I won in court twice. This attorney begged the judge with both hands in a prayer hold beggin please don't set a presentence you must arrest her and the judge told him he could not but told the attorney he could file criminal charges against me and told him what to file. Nice judge eh? He surely didn't help me with no lawyer. Anyway any ideas I would appreciate I cannot afford to go to jail I have a daughter to take care of. Thanks Bobbie

wouldn't the wins you have be proof that he is filing a "frivoulous" suit and couldn't you ask for him to be sanctioned?

I tried searching the PA statutes but it says they are not all on line yet and there may be cases that override what is posted.

You might be able to get one of those "free" consults from another atty. and pick his brain for info. and ammo.

What about " adventures in legal land" - marc stevens. The questions - I don't understand the charges etc.

c'mon HB you have a good handle on marc's stuff. Do you think it would be helpful in this instance?

I'd also shoot marc an email, and tell him your situation, and he may have a script for you.

Marc's stuff is the best in defensive situations, which depending on how you look at it, all situations in court are defensive.

Thanks for the link and I have a lot of defense ready but do I want to chance going to jail if I lose or can I just give up the car and hope he drops any other charges. Jail isn't worth me not being here for my daughter. I will go and look at the site now. Thanks

I believe you have the wrong idea.

This guy is not spanking you, he is threatening your life. He is threatening to have you thrown in prison, seperating you from your child, and ruining the life you now have, and further introducing you to scenarios that, until now, have only been the faint subject of TV movies.

He wants you to be a slave in prison.

Now that that picture is clear,

Forget about the automobile. If if were me, I'd sue the guy in Civil court for Malicious prosecution, and I'd take a reeeeeal hard look at the affidavit that he swore out for my criminal prosecution. I'd think there has to be something in there that is a dead out lie, or not firsthand knowledge.

When I found the weak link(s), I'd then make an affidavit stating the facts and present that at the arraignment, asking if I have the right to criminally pursue him, as he has enjoyed the right to pursue me, albeit falsely, and maliciously.

I'd do my dead level best to see that this guys ego cost him 3-5 years with Ben Dover as his cellmate.

If I were in your shoes, I'd think I had two options.

Prison for me, or Prison for him.

I am not advising you, just saying what I would do if I were in that situation.

How did you win the civil cases? Can you please post?
Would these wins be cases others would be able to cite if needed?

Like Henry said please get the book ASAP and contact marc.

Why don't you try appointing a fiduciary debtor for your "criminal complaint". I think appointing the AG of your state would do quite nicely to work in your best interest. They cannot refuse.

I have a format for this and it needs quite a bit of work because it is geared toward the IRS. Now remember ALL "CRIMES" ARE COMMERCIAL CRIMES!!!! So who better than the AG to handle the Trust for your strawman?

Or perhaps I would think about filing a misprisions in a higher court with an affidavit signed under penalty of purjury stating the facts of what happened. And what this crooked judge did in open court. If it's not too late get the transcripts so you can submit those as well. I understand the US Marshall can also assist you in this type of terrorism/RICO bs they are handing you. I would go to the news and see if they are interested in your story about what banks get the judges to do when they lose a case. Perhaps the towns folk will go to some other bank.

Maybe you too could go to the district attorney and file stalking and harrassment charges against the attorney who wants to get you into jail. File a complaint with the BAR as well.

THIS REALLY SUCKS!!!!! And I am soooooo glad you beat the bank. Maybe e-mail Jason too since he has expierence with legally getting title to a car.

I will send mojo to this creep. By the way I would also make the judges name and the attorney's name VERY PUBLIC!!!

Idea!

Why don't you go to members doc's and read what is bonding? Ask the attorney who is his bond company and what is his bond policy number?
He is coming at you in his private capacity attack him in his public domain.
Go after his bond.
