The Legal System
I received a call Monday evening for my best friend. She stated that her stepbrother's son has been in jail since November 2004. He was arrested in Connecticutt and broght to Missouri. She was told that his bond was set so high that his father can not afford to pay the bond. He visits him as often as possible and has seen bruises and cuts. His son told him that they beat him and put in solitary confinement on a regular basis. He has not had a court date and has been told that it may be 2 more years before he will get one.
The father is very distraught and what father wouldn't be. His son is 27 years old and was engaged to be married. He has been accused of murdering a young lady in Kansas.
The father has tried to get good legal help but can not get anyone to help because of expensive fees.
Need some help here pleaseeeeee!

You need to get your wits about you NOW!!! I've found a link that gives the guidelines in Missouri for a writ of habeas corpus..... Anyone can file it on behalf of a prisoner that has knowledge of the situation. I would state that this man upon the land is being denied a right to a sppedy trial by his peers and that he is being forced to undergo cruel & physical punsihment (i.e. torture at the hands of his captors) FILE THIS IN FEDERAL DISTRICT COURT!!! NOT THE STATE!!! That way you can end up in the US Supreme Court quickly !! (via US Court of Appeals if no luck at District)
I've heard that your supporting cites are the Constitution itself (dont use Title 28 cuz that classifies him as a 14th amendment citizen with revocable privledges, not rights)
His father should supply an affidavit describing his sons conditions along with documentation that has been already submitted to prison offcials concerning his treatment. Shows you have attempted admistrative remedy and gives the petiton more clout. This isnt legal advice by any means hope it helps you a bit.

I believe my friend told me Missouri but I may be wrong. The female that was found dead was from Fairway, Kansas. I don't know where she was murdered. I will check that information and let you know.
This young man's father said his son told him that every time that they tell him that he can make a telephone call, they unplug the phone as he is making the call. They are torching him in the same form as the middle east prisoners. People are up in arms over that, but it goes on in our jails on a regular basis.

Would you please clarify the statement above. I know that most of our political persons are of the HST corruption. Our ex-governor wrote the Patriot Acts. Does that tell anyone what is really going on in Missouri.
I really appreciate the information and will digest it and pass it onto my friend. The last ten years have really been hard on us. Our first involvement with the legal system, all in the civil courts until this case.
I know that we are all supposed to be presumed innocent, until proven guilty. But I also know that the system is about $$$$$$$$$$ and not about rights.

Your are presumed to be innocent until proven guilty in CIVIL COURT only. It's different in criminal courts, where ou ae presumed to be innocent until proven guilty. At least, in theory.

eureka, that is not the case.
you walk into a courtroom as an alleged "DEFENDANT" and you are GUILTY before INNOCENT.
period.
that is how it works today.
the "innocent until proven guilty" is a thing of the past.
traffic court is an excellent example, and so is so-called "family court."

IT'S REVERSED, GET IT??? That means the "established principle" that we are innocent until proven guilty, IS REVERSED right along with it.

Thanks for the so much needed education. So, we are improving...are we? If things are now different how come they (lawyers, media, etc.) don't expose it? Is is a deliberate intention behind that secrecy?

the simple answer is that their jobs depend upon the presumption of guilt before innocence. it is more lucrative to presume guilt and so on than to attempt to establish it.
spend some time thinking about that and looking around at this board (you can definitely see this in my traffic case) at the various cases, etc., that are encountered.

Around 10 years ago, big business started by up the news medias. NBC is owned by GE and so on. The news reporters are only allowed to report what big business okays. It is definitely a united effort against the people.
