My wife got her first "speeding" ticket.

Yes its true, she is no longer statutorily innocent. Even though she is confident in my ability to help her beat it, she still felt violated and angry. She was detained and ticketed for going 40mph in a 25mph school zone, just as the school zone went into effect at 2:00 p.m. She was able to call me at work while being detained and I instucted her to sign the citation "under duress, without prejudice UCC 1-207. She even said the officer laughed at the "under duress" part. I have all the information I need to handle this once the 72 hour contractual time limit is up, but does anyone have an affidavit for returning the "citation/invitation of contract" before the 72 hour period is up? I could just return it to the Clerk Of Court, but what is there to stop them from issuing a bench warrant with their carbon copy?

This could be fun. Since I beat my last two tickets, things have gotten dull. And you know what they say, "if you don't use it, you lose it." I have to go back through the old forum posts and brush up.

The UCC has absolutely nothing to do with criminal law. I've seen thousands of people make the UCC statement, but none of them has even gotten close to winning yet.

Tell your wife to pay up, and quit speeding in school zones. We all got to watch out for the young ones, ya know.

Yes, I know. We are very careful when driving through school zones, but this four lane stretch of road is 200 feet from the school and the second school zone in about a 1/2 mile stretch and she was driving through it as the clock entered the 2:00 p.m. zone limit change. (how do ya like that excuse?)

anyway, statutorily, I nor my wife have ever had any contractual obligation to abide by Revised Statute 32:64, so the root of the matter is in commerce or the lack thereof.

Bill, what does speeding have to do w/ criminal law when there is no corpus delcti?
What's the jurisdiction?
Common Law or Admiralty?
Has to be 1 of those 2
If it's common law, where's the injured party?

There is a lady here in Putnam County, Florida that is doing very nicely using the Redemption process in court, which includes the use of the UCC. I know this to be true because I have been a supporter of her process and have been to court with her. The court absolutely does not know what to do with her case. She has appointed the public pretender to be her fiduciary and what has transpired has been incredible. I will keep all informed on this one. She is in a criminal matter of driving without as license and she is in total control and doing a GREAT job of handling everything.

I was thinking about that concept yesterday and was wondering if it could be possible to do a UCC-1 on the PD by listing him as the grantee, & then putting his bond #, NAME, & the statute in the collateral box.

She ( I will call her Jane) has not put anyone on a UCC Financing Statement except her Strawman and has tendered a BoE in the matter. Jane has had her fiduciary file all the docs in the record and they have continued this thing so many times it is hilarious. The court wanted Jane to go for a psych eval and she had a number of people enter affidavits on her behalf, me being one of them. Then they wanted Jane to talk to someone from family and child services, go figure, and Jane had the lady that called wrapped around her fingure. The whole thing has been to get Jane to give them jurisdiction, which she has not done and will not do. This has really been a trip. I have had to laugh my butt off a few times at this whole situation. When this is over they will never give Jane another ticket.
