But NYJAIL4Judges would like to expand upon those thoughts.& In coffee shop conversations with neighbors about the Oath of Office, there are those who said, "so what, if it ain't on file and you find out... then they will just file it and do it right".& Wait a minute.& If you are going down the road in your car and the cop pulls you over for going through a stop sign, do you tell him to let you go so you can&back up and do it again so you may do it right this time?& There just ain't any going back.

What happens when that cop asks you who you are and you answer "John Smith"?& If he just accepted that and wrote you a ticket, we would all be John Smith for a moment.& You tell that cop you are John Smith and you better be prepared to prove it right there on the spot, or you will be looking at criminal impersonation charges.&
What's good for the goose is good for the gander.& Don't you think someone who tells you they are a judge ought to be prepared to prove it right there on the spot... before you go any further?

What happens if they can't prove they are a judge... and are just an impostor because they haven't met all the requirements of law to become a judge?& A still better question is: What happens if they weren't a judge when they fined you, or ordered your child to be seized, or sentenced you to jail?

You have to look upon the Oath of Office as a most serious thing... and living up to that Oath, as well.& We hear stories every week about someone whose rights were violated by a presumed-to-be judge.

Re:Then he ain't a judge!
Another cool idea.
Me, standing before the judge.
"Yes, your honor. May I see your driver's license and oath of office, please?"
Oh, that would be so much fun!& But when you think about--really think about it--there's absolutely no reason NOT to.
Go to a doctor? There's his "official certificate" to practice medicine. Lawyers? Hanging on the wall. (Not the lawyer, but his license. SHOULD be the lawyer....)
Judge? Sits there and we have NO clue if he is who he says.
Hell, yes. I like this stuff!

Re:Then he ain't a judge!
Yep - we are expected to show ID just to use a credit card, "drive" down the road, travel by air, etc.
So, shouldn't we be demanding verification of identification from somebody who claims to have the authority to take our house, kids, or put us behind bars?
Think on that,

Is simply asking in court for the "manditory judicial notice of thier oath of office" enough?
If we want to see the paper trail does the county clerk have all those records?

Re:Then he ain't a judge!
Yes, the County Clerk does have it.& In Harris county where I'm at, I was about to nail a judge for have a bond on file with the County Commissioner's office, but no oath attached to the bond.& So I was ready to lay it on her, but low and behold we find the oath on file with clerk of court's office on microfilm.& Well the way the statutes read, if the bond and oath are under the same roof, then they are filed together as required.
