P.R. Bond

Somewhere in this site, I read awhile back that I may be able to write my own pr bond.

Any help in locating this p.r. bond material would be greatly appreciated.

Just trying to get it straight

All I know for sure is that a "PR" bond is a bail bond that has been secured by the defendant’s personal pledge to appear in court or upon his "Personal Recognizance".

I am not sure if there has to be a bond hearing first. If that is true, then those are only heard after an arrest. Then the court is allowing the defendant to be released on his promise to appear when his case is called for trial. A *release letter with a PR Bond Form attached is provided to the Attorney or a family member of the individual in custody. This release letter is taken to the Detention Center to process the individual's release. The defendant must sign the PR Bond form acknowledging the conditions for his/her release. To receive a PR Bond you must prove to the Court that you are a reliable citizen with a good standing in the community.

A. Personal Recognizance

The defendant must be ordered released on own recognizance or upon execution of an unsecured appearance bond unless the court determines that conditions of release will not reasonably assure the appearance of the defendant. Magis. Ct. R. 6-401(A); Metro. Ct. R. 7-401(A).

If a person is released on recognizance, no bail is required. The defendant is required to sign an appearance bond prior to release. Criminal Form 9-302 (Order Setting Conditions of Release and Appearance Bond) (to be used when the defendant is released on an unsecured appearance bond).

Non-bond conditions (such as restrictions on travel, association, etc.) may be imposed as part of release on own recognizance as well as release on bond. Magis. Ct. R. 6-401(A); Metro. Ct. R. 7-401(A); Criminal Form 9-302 (Order Setting Conditions of Release and Appearance Bond).

When the court sets a personal recognizance bond, the defendant is released after making a promise to return to court when required. No money is paid.

I just found a boiler plate attached.
Happy Trails!! Keep on Smilin' :-)

Blacks Law 7th Ed page 1277

recognizances are aptly described as 'CONTRACTS made with the CROWN in it's judicial capacity.'

A recognizance is an acknowledgment of an obligation in court by the recognizor binding him to make a certain PAYMENT subject to the condition that on the performance of a SPECIFIED ACT the obligation shall be DISCHARGED.

recognizor= A recognizance is an acknowledgment upon RECORD of a former DEBT, and he who so acknowledges such DEBT to be DUE is termed the recognizor, and he to whom or for whose benefit he makes such acknowledgment is termed the recognizee.

CROWN PAYMENT SPECIFIED ACT DISCHARGED RECORD DEBT DUE

Ghee...

...I guess there won't be a bond issue (unless it' is within the realm of the united states court of international trade).
