Should I Sue, Or Shouldnt I Sue...........

Greetings All,

OK here is the Story. I went to a small Christian College from 1994-1997. The Church I had attended at that time had funded this particular college for 50 plus years. During My Freshman year, The church had some MAJOR doctrinal changes, resulting in a phenominal loss of bretheren....hence resulting in a closing of the school. Now here is the situation. My wife and I were both there at that tme. I was a Junior My wife was a Sophmore.

I had a double major in Music and Psych, My wife in Psych. Now, because we both attended a fairly religious school, we were forced to take classes that a normal 4 year school does not reccomend.....example, Old Testament Survey, Harmony of The Gospels, faith and the family.....etc

The agreement I had with the school was....Pay for 4 years....take the classes needed...get your degree. Pretty simple huh?

Well, when the school closed, it forced me and my wife to transfer. There was one school who would take our credits, but they wouldnt transfer our in state tuition since we were both from NY. We would have to start over again. Being that that wasnt an option, we decided to move to NY again. When we transfered to our school, we both lost 30-40 credits EACH.

Thats alot of time wasted. The classes not accepted towards our degree were the pre req's in theology, and a few other ones. Not having any background in legalese, My wife and I were told by the school committees that we werent entitled to a refund because we continued our degrees in psychology. I just said OK cause I didnt want the hassle.

Now I am much more upset looking at my student loan bill I have to pay.

So....I live in NY the school WAS in TX, but the headquarters ofthe Church that supported it IS IN CA.

Can people give me some starting advice? Should I be looking up laws/ statutes of limitations in NY, TX or CA? How would I begin filings?

Also, I took me a long while to even consider this because it is a Church. I gave them years of tithing, so that justified it for me.

Any thoughts?

Who loaned you the money? Was it a government guaranteed student loan? If so, you may be able to get your loan reducued because your school closed. I did. When the school I was going to closed, Citibank reduced my $7,500 loan to $5,000.

Call your school and check. They may have a policy on school closings.

hey, thanks for the reply. I think that would be a step after my suit. Im not saying that they shouldnt reduce it, but the contract is with the school, not the loan company. So, I would like to go after them (church).

How did you go through the loan reduction process?
