“Star Chamber” Tactics Alive and Well

Here is an article that about says it all regarding the courts today. Are they courts of "law" or do we have star chambers?

As someone whose boss gets court appointed defense cases, I sadly agree.

Plea bargain is a wonderful tool to clear dockets when the defendant knows he's guilty and can bargain to a lesser offense just to save everyone time and trouble.

It sucks when a prosecutor abuses the option to get convictions for the sake of convictions, and I see TOO MANY times when they basically throw everything they can at an accused IF he opts for his day in court. Nothing you can do about it either.

Even worse is that cops are getting as bad...charging for anything they can if they want to. :(

A part of me would like to be a prosecutor just because I'd at least use the office wisely, but I doubt I'd ever get hired with my attitute on the matter.

Prosecutors forget that their highest duty is to nail the RIGHT person for the crime, not whomever is handed to them to prosecute. Sometimes the WRONG person gets accused, and they should know that you can have all good facts but arranged the wrong way will produce a lie. :(

In my opinion, the best option is to restrict the power of the prosecutor and make them subject to civil and criminal penalties for abuse of power. Of course, that would NEVER happen. :(

The inherrent problem with power is that it does vast damage in the hands of the wrong people. The solution would be to put people of true integrity in positions of power, but the world does't work that way. If you restrict the power, you compensate for the flaws in the people who hold such positions, but at the expense of making them less effective.
