MVA @ Walmart?

Tonight as I was leaving Walmart, I stopped in the lane to pick up my wife, and daughter. As I was standing still,a large Jeep Cherookee backed into us, and caused damage to our vehicle. I did not feel as though I wanted my insurance company involved, or notified, so I refused to give him my insurance info. As a result he refused to give me his. I have the tag number, and can get the registration. My question is this. Does anyone think I have a chance if I get an estimate, and sue him in civil court? All I want is the car fixed. I don't want the insurance hassle.
Also does anyone know if I am legally obligated to provide my insurance on private property where I was not at fault for the damage incurred?

What is the point of having insurance if you don't make use of it?

Most folks I know even carry one of those "disposable cameras" in their car for just such a situation. Now it becomes a matter of "he said/she said"... dontcha think?

I'm not surprised that he didn't call the cops on ya for "not having insurance" on the basis that you refused to provide the name of the carrier.

What is the damage? How much do you think it will cost to repair as opposed to going after the guy in court and reliving the entire scene all over again as well as taking the risk of an unfavorable judgment? Is it worth the trouble?

Don't Use It

Not using insurance is a very good idea, even if you have it. When I was on my father’s insurance I damage my car in an ice storm. The insurance company jacked up my insurance 100% in two years.

I would go after the individual.

My advice is to only use insurance if it is a catastrophic incident.

That was kind of my idea. I am not free with private information, and I don't throw insurance around without a severe necessity. If there had been physical injury involved it would be a different matter. I figured since the guy was being a jerk, and I can get the video showing fault that I might be able to make a small claims without insurance ever being involved.

Will BB try to insert themselves? In this state, it is REQUIRED to file a police report -- hence, if you attempt to go into state court, they may charge you with failure to report an accident.

No. Here, on private property the police will not even get involved. Hence no report.

WITHOUT PREJUDICE
Many insurance companies from what I gather used to (and may still) not cover damages on parking lots because they are private property. So giving them notice of the collission might cause them to raise the rates and still they might not cover it.
