Statute of limitations is up

Got a notice today from courthouse that we are being sued by Discover, and SOL has been up for over a year. This is about the third set of attorneys that has purchased this debt, and last year I tendered a CPN. What kind of dismissal do I move for when the SOL is up? This debt was originally terminated in april of 2001. SOL was up in April of 2004. The suit is just now being filed. This is about the third or 4th debt that this group of attorneys has purchased of ours. They have already won one judgement back in January. That debt was also terminated in 2001, but they got that suit filed in 2003. I would love to get something on these guys, but now I would just be happy to get this case dismissed. Thanks,

They will never go away, as long as the debt is not discharged with prejudice in court, unless the statue of limitation expire. Is it disharged with prejudice, without prejudice or just a plain dismissed. Which one?
