Judicial Authority???

Can someone direct me to information on Judicial Authority and how it applies to the Dept. of Revenue suspending my license. To the best of my knowledge, there was not a judicial order to suspend my license. I only received a letter of intent to suspend my license if I did not pay back support at the time.

gatorguy, they don't need judicial authority. Your license is a state granted privilege, for which you applied for. The state, through any of it's agencies can take away your privileges if you violate or fail to comply with any of it's rules or regulations. As you probably know by now, most states have tied their child support statutes in with department of revenue, law enforcement, and other state agencies (through information sharing) in order to form a more efficient revenue making machine. The judiciary has nothing to say about it.

In reality, this situation, alone proves that DL situations are not judicial at all. Any agency is part of a department. Any department is w/in the executive branch

Anything w/in the executive branch is subject to the APA.

Gator Guy, when one applies for a DL, they are waiving their right to travel and accepting their ability to sojourn in an automobile as a STATE ordained privilege rather than a natural right

YOu are going to find out up the road that this is really an "all or nothing at all" thing. There is no half pregnant

The DL came up for renewal last Aug for my Birthday and I will never renew it again

Just have to know how to tango with these beasts
