Judgement for Lawyer fees/ Now Order for Appearance/Examination



I&have a judgement for an attorneys fees, appx. $9000. It has since went to a 3rd party debt collector for collection. Now the 3rd party debt collector has obtained a Order to Appear for Examination on me. My home is in a irrevocable trust, I have 2 cars, one financed, the other no-oped and broken transmission. I have normal furniture, no stocks or bonds, an average daily balance of $50 in my only bank account, and I work under the table-no income verifiable or garnishable.


Anyone want to give thier opinion on how I could handle this? I think personally they(debtcollector) is up the creek. Suggestions are appreciated.

Welcome to the forum.

First You are already on the wrong side of the thought process about this. If you continue to think this way you will lose.

From your post, it seems that you are concerned about them taking your possessions. Instead of worrying about that--why not ask them to verify the alleged debt? Why not ask them if they purchased the alleged debt? Why not ask them to provide the original contract (like there is one) of the alleged obligation?

I'm not sure on your knowledge level about such things but, from what I gather from your post--you may not have adopted a certain mindset to deal with the fraud that is being perpetrated. Therefore, I think more study is needed. Not to imply that you do not study.

Two important issues with 3rd party debt collectors: if they purchased the "account" they won't be able to collect because the will have no evidence of the debt (evidence cannot be purchased) and they cannot "verify" the debt from first hand knowledge.& There are case cites and definitions located in a few of the threads in this section and in "Banks, Collectors and CRA'S"


Welcome to the suijuris... take advantage of the info that is found here in the forum, downloads and front page stories.& The info that you are seeking is here... but it&may still be&informative to see what other members may suggest.

Don't "hide" from them (neither yourself nor your "stuff")


Fight back! Stand up to 'em. You're doing what they expect, what they're used to. Screw with their&pea-brains and arrogance. Ask THEM to do what they DEMAND YOU do: Follow the damned law!& (Remember: This is not a popularity contest, right?)
