New to the Forum... Incident with CA police



Hi,


I'm new to the forum and new to California law. So I have a question why do you have to the&sign ticket in California? (I'm from New Jersey and never had to do that.)


And the best thing is that when I tried to ask the officer why? He said he can arrest me for holding him up. I don't remember there being any laws that say an officer can arrest you if you hold him up.


The sargent that was there too, also told me that I had to sign the ticket... I asked why and he said "Because if&you don't I will arrest you and take you to jail, where you will be held for the night, because the majistrate will not be in until 9am. So it's either sign the ticket or get arrested!"


Can they do this? Arrest someone for not signing the ticket.

They really want you to enter the contract. There are several ways to handle this. One is to write "Without Prejudice UCC1-207" under your signature. You really need to understand this though before you use it. Read the forum here. Do a search. Also check out:

You probably should have asked for the authorization for him to jail you without cause for not signing something. A signature denotes voluntary action. You can also put DTC (duress, threat and coercion) since you were threatened.

Another tactic is to put "non-assumpsit" over your signature, which means "no promise to perform or act". See:

According to Rice McLeod, there is something called the 10 day rule in effect with tickets. After 3 days (72 hours) you have a valid contract. After 7 days, you've defaulted and after 10 days, you have summary judgment against you. In the seminar area here are several Rice McLeod audios. I think the one from december of 2003 has this info:

When I was at TSN I posted in regards to the fact that they cannot arrest you for traffic violations... I have those posts in my files somewhere and will try to locate them... if anyone else has that same info... it would be appreciated.
