OCTOBER UPDATE;Credit Card in Court

Seeker,

Sorry to disapoint you but you did not have your "day in court". You were in an "administrative hearing". Next time go to court.

OCTOBER UPDATE;Credit Card in Court

seeker,

i was/am in your same shoes.

i got steamrollered in court because of "da rulz."

at that point i just decided to let it be and go to default judgement as i hadn't the knowledge then to do anything else.

so, after the judgement was awarded i then received a summons for an asset discovery hearing. once i received that i removed my name from everything i could and only began the bankruptcy process (just days before the exam hearing). i did NOT complete that process, just started it as it put a hold on any debt collection activity. upon receiving the next piece of paper from the debt collector attorney, i sent a VoD to him.

not that i expect this case to be over, but, i haven't heard anything yet...and that was over a year ago at least. when i have time i intend to pursue the void judgement route and go further if possible.

expect a summons for a debtor's exam once final judgment is issued.

my thoughts are with ya!

jon

If you receive a summons, kill it upon arrival!!! Don't play around with these thugs!!! Don't let the judge get a way with what he did!!!!!!! Get a copy of the transcript and file a claim against his bond. You can't be afraid to make them do their job.
