Hello Ice, It's learning in memphis.& Got a question.& I recently got in a 4 video seminar that winston strout did.& The information is great but quality of video so,so.& Let's say that you mail in documents to the court clerk, these documents include a ucc filing, but upon recieving the documents back I saw that some of the documents weren't stamped as being filed like the ucc1.& So isn't there something you could do with a notary about the clerk's dishonor by not filing your document.& Remember I have very limited court exp at the moment.

aintmyfault & acicalla,
One of the first and primary steps is NEVER FILE ANYTHING BY MAIL!!!& If you do it in person you can then receive a time stamped copy for your records.& If at any time the judge claims he cannot find the docs, you can offer him yours to use for that session as long as he will return them back to you at the end of the session.& You will be surprised at how fast the judge will find the docs in the file.
Second, the most important docs you can file ARE NOT the docs that demonstrate your secured party status or anything to do with the copyright notice.& You can take the road of least resistance and accomplish more -- or you can file all those "arguments" and make an enemy of the court.& As always, it's your choice.
As far as the clerk not doing their job... you can file a complaint for suit against the clerk if you want to push your point... but seek to "enlighten" the clerk regarding their duties & responsibilities as well as the penalties for non performance first.& And if you file suit add conspiracy to the charge... any clerk that refuses to file documents that are pertinent into an ongoing case file MUST be in collusion with your opponent.
But, I stress this point again and again --- FILE YOUR DOCUMENTS IN PERSON.

"I mentioned that there were no enacting clauses on the law I was accused of breaking, between the title and the body of the law and& it was null and void.& The& DA did not object ... just sat there with love in his eyes toward his god on the bench, the Judge said, "dismissed!""
When the judge "dismissed" - what was the judge dismissing?& Maybe you should have said thank you for dismissing the case and started to pack up your stuff??
Another question:& When you objected and the judge overruled... did you follow all the way through with your objection to the point of filing an interlocutory appeal?& If you are not aware of this... check the files that are offered here... there are some things that you may be able to use.

hello, Ice it's not always possible to file in person.& When I did the filing& I am talking about I was in jail.& I know that the docs were left out on purpose, but in the future if I ever get into the same situation I want to know how to take care of& it.&

Are you all alone in the world?& Don't you have family or, at least, one trusted friend that could file the docs for you?& I know a guy that had a sheriffs deputy file docs for him while he was in county jail... and the deputy brought him back his time stamped copies.& Those filings secured his release and ultimately the charges were dismissed.
(Just because someone works for the system does not mean they are one of the "Bad Guys".& There are even some judges on our side.)
