Affidavit help

I'm going to file an affidavit of truth with the court in my wife's ongoing custody battle to set the record straight on the false accusation of abuse and neglect that this suit was filed by her ex's attorney. My question is this. In the Writing Affidavits download it states that the facts should be in present tense. However, the facts are past and present. I would think that a fact 6 months ago is still fact today. In other words, if we were'nt abusing and neglecting the children back then and we aren't presently doesn't that fact tie in hand in hand wether past of present? Why must the affidavit be in present tense only?

Affiant is not nor never has ....



Just include both past and present, that is fine.

Attachments to the affidavit in original form or copies? I think for them to be "valid" they need to be originals.

I would get the notory to certify a copy of your attatchment as a true copy of the orig. and attatch that. That way you keep the orig. for yourself. Or you can attach the orig., it is up to you.
