What about Ex Parte Communication?

I have proof of it.

I was known by both parties to be waiting on a hearing that should have started 20 minutes earlier.

The Attorney went into the area of the hearing, and 3-4 minutes later came out and informed me that the hearing was being continued.

I then get a motion in the mail that shows that he entered the motion and had the order signed without my being present.

and I was right outside the door with their knowledge of same.

How does one attack this?

Just fishing for thoughts at the present.

Ex parte communication

Hello Harry

In your first post you said "I then get a motion in the mail that shows that he entered the motion and had the order signed without my being present."

When was the motion filed? When was the order signed and dated? You have ten days to respond to a motion. If the order was signed within that ten day period, the sludge denied you time to respond and denied your due process rights. So if they had subject matter jurisdiction, they lost it by doing that act against you. And any judgment unless it is in your favor will be void.
