NOTICE OF DEFICIENCY

Just received my first Notice of Deficiency, says I have 90 days to file answer with U.S. Tax Court. Any good ideas on how to respond? Will refusal for Cause F.R.C.P.9b do any good? LT2DOGS

NOTICE OF DEFICIENCY

Whatever you do, do it within 72 hours of receipt of the NOD. I personally would include an affidavit that I responded within 72 hours of receipt. Don't ignore this thing.



There are several paths to follow. It's hard to know without knowing what has happened up to this point. Any background?

NOTICE OF DEFICIENCY

I do intend to respond within 72hrs, as far as what has transpired so far,a rough outline is-received CP-515 notice late summer last year for year 2000-returned with questionare and marked original with notes indicating that I was questioning jurisdiction, authority, definitions, etc. per Richard Standrings info, which at the time I was only beginning to learn. Filed a 1041 in 2001 (for 2000)and got a letter late last fall requesting a meeting to discuss the Trust documentation- the first letter had an incorrect name ( same family name-different first name)as the Fiduciary, and I returned it saying that it wasn't me. Agent sent me back the duplicate with the name corrected, but still addressing the strawman. I sent it back and questioned jurisdiction, notified them of my status a a Fiduciary, for the Trust and demanded thier authority to operate within the several states, notified the agent that she did not have my permission to make a legal determination for me, and notified her of Trademark/Copyright notices,POA, Notice of Competency.

Mid-February, I received the letter from Dennis Parizek, stating that it would be unfortunate if a TAXPAYER were to rely on arguments that I had made.(Didn't make any arguments, just asked a few questions). Today received Notice of Deficiency for 2001-doesn't mention Trust or Ein, but has my Strawman and SSN.
