Attorney admits judges are bankers
i conversed with a attorney today about a family law issue and he told me the judge would not sign a particular contract i was putting together without including a child support obligation. i told the attorney "sure, the judge has to make sure the state gets it's cut". the attorney replied,"correct, according to federal law, the judge has to include child support payments in everything he does". i said, "so, the judge is in actuality a banker, representing the state". the attorney laughed and said "you are correct, thats what it is all about". we laughed and talked a little more and he explained that everything i was saying is correct, that its all about the state collecting government funds from the feds. peeace.

I don't know how federal law can insist a state judge (divorce, custody and domestic relations being state, not federal, legal topics) do anything, particularly set child support on every decree.
Your lawyer doesn't seem real. He talks nonsense, and he does it in short sentences.

At the beginning of my odyssey, I personally had a conversation with a retired state judge, who explained the entire senario quite thoroughly....
It's really quite simple.
The fed sets the standards for it's programs.. If the state admin (human services) doesn't meet the standards, they don't get their kickback from the fed.. So the state admin leins on the judges (appointed, not elected here), and tells them the criteria they are expected to meet.
His exact words were "Human Services has an extremely clandestine meeting with every judge in the state, where they are instructed how they are expected to rule in cases involving human services clientele"
If the judge doesn't comply, he simply won't be appointed when his next term comes due (every 7 years). No fanfare, no commitees.. no reappointment.... no career.

The name varies from state to state...social services, child protective services, human services... Now they call themselves DHHS, Dept Health & Human Services.. as DHS, now means Dept. Homeland Security.. lol

That's a nice conspiracy theory, that state judges who don't comply with federal guidelines "won't be re-appointed," but it doesn't wash. In my state, ALL judges, from magistrates all the way up to state Supreme Court justices, are elected.

Its a pretty accurate picture what goes on behind the scenes. If the feds fund a program....they get to pull strings. In Michigan, the Secretary of State was threatened if they didnt comply with the federal requirement of obtaining SSN numbers from licensees upon renewal, federal funding to Michigan DOT would be cut off. Then Secretary Miller tried to fight the issue in federal court and lost and then capitulated. Dont tell me that state stooges (judges) arent set in their place from the get-go and yes the politicos can shut down their careers since in most states the courts are adminstrative tribunals created by and and subject to the legislature. No separation of powers at all. Besides without PAC money from the politicos and special interests....those losers dont get reelected. Almost no one pays attention to judicial elections outside of special interest groups anyway. Anyone who stands in the way of federal funds is going to be dealt with by the system one way or the other. Wake up and smell the reality silly attorney!
