Juvy Court

My mom has to take my little brothers in to a juvy court tomorrow. She has a questioner they gave her to fill out , with questions like, are they from a broken home etc.. I told her not to sign it. They are going cause they threw a boy into a trash can for keying my moms car and thier dad pressed charges against my little brother. Well the cops never did nothing about the vandalism to my moms car. Any suggestions on what my mom should do or say when they try to make them sign papers?

First - this is not legal advice and getting legal advice off the internet from people you can't look square in the eyes is dumb but here goes:

Doing something illegal because someone else did something illegal isn't a good defense.

Again, this isn't legal advice but ask for a public defender before she signs anything. She isn't qualified to defend them let alone sign something that may incriminate them or her.

So what is a good defense?

If mom wasn't served she might consider staying home. A juvenile has no standing in court without the adult.

Well for one thing, Could she mtion to dismiss for lack of jurisdiction. Because They are going before a juvy officer and not a judge which the constitution provides trial by Jury and not by Juvy officer? Just A suggestion

I was thinking of this

Walk in and say” I need to clarify some things before we can start.”

1. You have Taken an Oath of office. Is that correct?

2. Persuant to your oath, in your preformance of your official duties, including those before this court, you are required to abide by that oath. Is that correct?

3. Does this court abide by all the powers of and Rights guaranteed to American Citizens in the federal and state constitution, including due process of law?

(He will say yes, right there and then you say “ I believe the constitutions guarantee my kids to a trial by Jury and not by a Juvinile officer, This matter at this time is over. Thank you and goodbye.”

What do you think?

Sounds reasonable but I bet the juvy jerk won't let it slide that easy! Everything has to be so official in this day and age of computers and telescopes probing every orifice. Too bad the "father" is a "she-male"! He shoulda clobbered his rotten kid for keying the car. And the son is a "she-male" in training for running home to hide in "daddy's" skirt. Flaccid Pretenders without a clue. Or just "good citizens" suitably emasculated and paper Trained by our "benefactors". Sorry to hear of your plight. JRB is giving some good advice concerning getting a public defender to help out. These people in the juvy justice end of law enforcement may be worse than their counterparts in the "adult" end of the courthouse as they can do just about anything they want with little chances of any kind of backlash. It does seem that there is a noticable lack of Equal Protection Under the Law regarding the administration of Juvenille Justice. Your posted questions/statements are thought provoking and concise, and would do a good job of getting the judge all mad! Dude go to law school, you are a natural! We need REAL Attorneys that are not afraid to stand up to corruption in the courts (which is rampant) and help to defend guys like your brother and mom from trash just like this. The neighbor kid's father should be bitch-slapped for his behaviour in this matter. What kind of an example he is setting for his child?
