Can A Judge order ?
Last month I got primary custody of my 17 year old son. Mom gets every other weekend and Wednesday night.
The Judge ordered that my son must go to church with his mom when he is with her. Is that order valid.
He also ordered my son to submit to drug testing based on his mom's testimony that he is smoking pot. I think it was part of her straightly in keeping custody of him. Is this order valid too?
My son now refuses to go to his mom's. Am I in violation if he chouses not to go?

The church thing sounds really strange. The drug testing, well, there are plenty of products on the market to beat ANY test they may give. Who pays for the testing?
At 17, you might as well think about emancipation, which would put an end to "can they do this". Just something you and your son may wish to look into.

I left that post in bad shape, sorry. The question isn't if the judge can do this, he/she did do it. The question is how legal is it?
There is no way in hell a judge can lawfully order anyone to go to church. That's a full blown violation of civil/constitutional rights. Seperation of state and church comes to mind.
The drug testing could be a-ok. You don't really tell us what brought all this on. What witch hunt "jail the heads" state are you in? Pot should be the least of a judges worries.
Now, what would one do if this judge is wrong? Well, this would depend on just how much free time and how big your bank account is. Do you really want to get into a fight with a Judge, when his buddies will be the ref's?? And, if you did, and you lost, you would pay dearly for it. Tough position to be in.
One thing I learned, If the mother should be in contempt of court, she can NOT file for contempt against you for contempt. Let me refrase that, she can file, but you can get it dismissed. There is something called the clean hands doctorine. This is where I live, I don't know how it would work where you are, as I don't know where you are.
Contempt of court is minimal. A small fine, say $25-100. But, a violation of the order, if the judge can dream something else up, could change custody. I would think you can take one contempt charge without much happening.
Something else you could do, if time has not passed, is file a motion for reconsideration from the judge. Judge are people too, although we don't like to admit it, and do have bad days and screw with you and me to make their day a little better than ours. You may get that taken out, or you may not, but I would try.
The other thing you can do, if you really want to get into it, is file in Federal court, asking the court to throw that order out. They will NOT hear the family law part of it, but can and will decide if you and your sons rights are being violated by having religion rammed down your throat. That there looks like a good action to me, and a simple one. Don't complicate it with things you just want to clearify, just stick to the whole church and being forced to go to church thing and you should win that case easily.

The Church deal was part of Mom's plan to keep custody of my son. Her Atty advised her that the Judge was real big on Church as she made it her theam as it was in his best interest to live with mom because she will take him to church. Yep her and her live in boyfriend will go to church. lol. So the cleark put that in the jurnal entry.
The drug test is not a big deal but he has never tested before so why start now.
My big concern is he refueses to go to mom's because last time he went she took him to late church services and missed work and got fired. He got his job back but now resents his mom.
If I put him in a head lock and force him in the car with mom I will be a child abuser right? My son is 6'2'' and 220 lbs. I have SRS reports of abuse by mom as a foundation as to why he doesnt want to go and spend time with her. She just wants to punish him for wanting to live with me. And her child support dropps a chunk too.
She is in violation of the seperation agreement by not providing school records on my youngest, She also has not paid tuition on my oldest sons college that is in the seperation agreement too.
She has also interfeered with my visitation with my youngest so her hands are not clean.

If she has a boyfriend living with her, custody can and should change hands! I have some case law on that.
If she is refusing school records, fine. Just send a letter to the school, or go to the school and get them. Again, where I live neither parent can be denied school records. Make them show you the law that this can be done.
If she is in violation of the order, and you feel that you aren't, file a simple contempt charge against her. And next month when she does or doesn't do something, do it again.
If dear old mom is desrespectfull of visitation, custody can change. I got case law on that. (Even being consistantly late can do this!!).
Why did you marry this woman??

How would you like to get the "worst" Judge in your County booted off the bench, publicly shamed for his/her rampant corruption and civil rights violations against the local People, exposed for his/her many knowing frauds and etc., and suddenly facing a large public demand for criminal charges filed against him/her -- and, all of that naturally sending immediate, deep chills into all of the other local judges and government officials, too??
Do you want it to really happen? Soon? You actually can make it happen! Yes, you can... It's real.
Here's how:
Become a listed County Team Leader for UCRCoA, if you're not already. That's basically it, with a couple of small tasks below. Join the hundreds of other CTL's already listed online, many of them also ready to boot their worst local judge off the bench, and to hold those "favorite" judges fully accountable for their actions:

You see, as the listed Team Leader for any given county, you also become the Moderator of that corresponding local Yahoo Group for your county, with the electronic moderator "permissions" on that same Yahoo Group to do the things that regular members can't do... such as create the Poll on your county group for everyone there to vote for:
"The Worst Judge in [Xxxxxxx] County"
So what good is that going to do, you say? A lot of good, at the right time coming very soon:
UCRCoA's "launchdate" for the two "hand-in-hand" items of the family rights classactions --- (1) the national electronic saturation blitz, and (2) the geographical distribution of the classaction legal packages, actually out to all county team leaders and county groups --- is planned for the very same day that we finally have the last of the 952 "red" counties in America listed online with an active team leader. A "red" county is simply one of the 3140 USA counties (and independent cities) that has a July 1st, 2006 U.S. Census population estimate of 50,000 persons or more. With targeting control of these particular 952 counties, we will control physical and online representation and guidance for over 86% of the entire American population, which officially crossed over 300 million as of last Fall (mid-October, 2006)... That's six (6) out of every seven (7) Americans... everywhere...
The "red" counties are also "a natural" for our purposes: (1) with more population, finding local activists there becomes that much easier, and (2) we need those sets of [bigger numbers of people] as fast as we can get 'em --- sooo, the higher populated counties are "our best friends"... UCRCoA already has over 600 counties "taken" by CTL's, and most of that was put together online by a mere two -- just two -- people working off and on for a few months... This "guerilla warfare" process of repeatedly e-blitzing most of America's online population with our standard messages over several days WILL result in TONS of new people from all over the country JOINING our UCRCoA county/city Yahoo Groups everywhere... This was the core design goal from the very beginning... Indeed, we reasonably do expect to "hit" some 160-190 million people online with these methods... that's "million"... and, since MOST of America's families and extended families have been severely damaged by our family courts, we also reasonably expect to have at least 5-9 million new people join immediately into our 3000+ county Yahoo Groups within that next 1-2 weeks... if not millions and millions more... with each local group of newly-joined people READY AND HUNGRY FOR FRESH ACTION, and for YOU to lead them (with our help, of course).

Everyone affected by that Judge then files their official judicial complaint against him/her -- i.e., hundreds or thousands of them -- all at about the same time, roughly that same week or two. Additionally, UCRCoA may also provide other sorts of "paper revolution" accountability methods, such as a separate, general torts lawsuit against your favorite judge, or who knows by then what else we can come up with for distribution...
The point is, that instead of THEM "ganging up" on YOU, that WE will "gang up" on THEM, one at a time as needed, until the system gives in to change... real change... and, remember: we still outnumber government officials, by a least a factor of 10,000-to-1... but, there's no need for a physical revolution, as we will be able to slaughter government into shock, by the sheer force of our overwhelming amount of paperwork(s) and voices...

And the problem here is, you ain't getting the judge removed in family law. Sorry, try as you may, and even IF you could, you'd get the worst SOB the state could send your way.
Family law followes its own rules. You need to know this, or you're going to get bent over, screwed till your blue, and sent home broke. All this crap of stiring **** with a judge in completely insane! The judge in all probability is going off the paper work alone, and has ABSOLUTE descretion in these matters. Very few cases will ever be looked at by a higher court. You need to know the rules, have a great arguement, and go from there.
Filing of bogus papers will only lead you to a quicker end. Family law is no place to try to be the "paytriot", and this is proven on this site alone, from loss after loss after loss of playing some sick, twisted game in hopes of winning the case.
I've only read of two (2) men on this site that have won custody doing things the way the need to be done. BOTH BANNED MEMBERS. So, what are you looking for?
