Is the doctrine of Partus Sequitur Ventrem a basis in Family and Divorce Courts?

Definition:

Partus Sequitur Ventrem - The offspring follows the mother; the brood of an animal belongs to owner of the dam; the offspring of a slave belongs to the owner of the mother, or follow the condition of the mother. A maxim of civil law, which has been adopted in the law of England in regards to animals, though never allowed in the case of human beings. 2 Bl.Comm. 390, 94; Fortes.42. - Black's Law Dictionary, 4th Ed.

Seeing that many men are crushed by Family and Divorce Courts (not withstanding the marriage license and other invisible contracts attached therein), I would believe there would be more fervor on mens' part to engage in status correction in order to retain one's rights to their children.

I must apologize for not having more case law sights. I will seek to rectify this in the very near future.
