Dealing with Step-Parent through Paper Trail
I know there is remedy through serving affidavits etc. from what is perceived as to have a contractual basis behind their request which of course is done through commerce UCC. I also understand there is a duty to resolve items outside of court if there is conflict.
I have a parenting agreement through the courts with my son's mom. The step-father has a temper, and angry ass hole starts yelling arguments with her, punches things, throws things and although he doesn't physically abuse my son besides excessive unnecessary spanking, he instigates a lot of mental harm. She also feels compelled to neglect my participation with my son and our agreement because he throws a temper tantrum like a little toddler.
Regardless I filed for custody and am almost done and everything looks like it will be very promising for me, obviously, but again he is not party to the contract and I don't want to pull him in which would give him rights with regard to my son.
So what are proper ways that could be held up legally in court to deal with conflict where no contract exists? I know overall anything you do to create a paper trail can support your case if you moved to the courts.
Affidavits? Claim of Rights?
Mainly the focus is wanting to address the issues on paper including questions to provide the laws that allow him to interfere with my contract with my sons mom, documentation that shows he is his Father and that I am not etc.
Also serve notices of what I am demanding he stop? and can I serve a claim of rights with these items that will take effect if defaulted?
