"Child Support" - Colorado

Hello Everyone! I am new to posting on the forums and have used these forums recently to expand knowledge upon my own first hand experiences with "Family" courts, or what I have witnessed "Please Break Up Our Family" courts.

Regardless I have come to the conclusion that it is my own fault for not knowing the law and deferring such to costly lawyers that have left me over the table and them not even asking for some lube at least for me.

This post will be on child support and more specifically child support enforcement; however, I must state that I am very involved with my children and am constantly dedicated and in progress to "obtain" more time. As well I do not seek such information to dodge my own obligations as I see fit to supporting my children. I find it ironic however when even the presentment is made that I have the capability to watch my children from home since I work from home as well that they still refuse to include that in the agreement and then subject me to be responsible for daycare costs of the mother. As well I can quite clearly show that the money is not all being used on my children but Colorado Statutes do not make them accountable anyways.

Brief history: I was proceeding in two different parental agreement matters at the same time with both of my children's mothers. Regardless of the parental agreement, I was working a technical job as a webmaster at 30k per year. The support judgments were $612 & $628 = $1,240 a month to pay in support. After taxes etc. I was taking home around $1,850 a month full time. Even presenting such to the courts did not matter regardless if I had them every weekend and no consideration is taken into account as to my responsibility to provide a safe environment in my time with them as well. I was taking home less that rent was on my single bedroom apartment.

Before I was working hard on my credit score and almost had it up to $700. But, When my checks were being garnished at 65% and was still falling $400 a month behind on top of that the arrears were adding up. It came down to 1. Give up that time with my children and work two full time jobs to pay child support. 2. Assume the arrears and provide for my childrens needs as much as possible on $680 a month. I did do contract work on the side here and there to delay having to lose my apartment till the lease was up.

Needless to say my credit now is 412 because the state posted arrears on the report and it shows like -180 -180-240 etc.

What is my remedy? How can child support enforcement Legally force me to send them a check as if I was receiving a service or had a loan, and then even post it to my credit report when there is no credit given? I have a court order to pay support, but does not mention to do so to any agency. Even though I pay about half or the amount a month I get threats, lien threats, drivers license loss, credit loss etc.

Personally I don't care about losing those "privileges" anymore. I do understand through the statutes and even in the USC there is reference to enforcing "child support obligations". Is there anyone with insight into this matter?

I do understand I originally submitted to their jurisdiction. I do understand there is a court order that is being acted upon. I do understand that there are statutes granting agencies to be created and enforce those obligations. But there must be remedy somewhere.

I will be glad to provide more detail as needed.

Our situations are practically identical... 'cept I am in California. I have been exploring some remedies, but I am not settled on any particular methodology yet. I did however stumble across a possible remedy in another child support thread (http://www.suijuris.net/forum/court/...port-help.html) in the form of a child support bond... Give it a good look. Then there is a Title 18 challenge (http://www.suijuris.net/forum/family...child+support). I think there is actually some merit to this one. However, I have not researched whether there has been any success with it. I am also going to seek David Merrill's help with preparing a Libel of Review with the U.S. District Court. That, I think, may be the proverbial "wooden stake" to get a remedy ab initio (from the beginning). I am going to begin my journey into trying these methods soon. I'm trying not to be so desperate that I screw up the procedure. I will definitely post the outcomes (good or bad).
