Adoption

Hi

Here's a situation, the birth certificate was not signed by the bio-father (refused). The mum marries someone else who wants to adopt the child. Will this be a big nightmare or will it be easy? BTW the bio-father never saw the child made no effort to see the child, and lives in another country where it is very hard for them to get visa's into the US.

Another question the child is a Canadian citizen and lives in the US with the mother and father who wants to adopt her, is the adoption subject to Canadian law or American law?
