"demand that the judges and lawyers either state a claim against me upon which relief may be granted, or dismiss the case with prejudice for failure to state a claim upon which relief may be granted"
If this is done--demanded, stated nicely, or otherwise--what are the options for the court? What I mean is what if the judge states a claim? How would he/she do so? How would I know if he/she is bluffing? Am I asking the correct questions???
I am tired of being a non factor in my child's life. I am tired of being told I am unimportant for anything other than money. Mothers are important. Fathers are equally important.

:!: Way to go, Gator! Bite 'em!
My son is a single Dad, and he tries to maintain a decent relationship with his son's mom. Sometimes it even works! Both 'boys' live with us, and Dad goes to PTA, school conferences etc, or we in his absence. Mom is noticibly absent for most functions. She had the gall to ask about child support (Yeah, we'd love some help here, MOM!) She still files tax returns and grabbed a HUGE earned income even though the boy was with her MAYBE (I am being generous here!)30 - 45 days last year. And no monetary support either. But the kid is happy, secure and inquisitive and his curiosity is encouraged and fulfilled here. And we know where he is and WHO is caring for him (and how!), and he is a joy. Keeps us active, that's for sure! We are considering home educating, if Mom doesn't throw up too ibg a fuss. Here's a question -- without going into the "arena" how does a parent establish primary rights? (does 'possession' count?)
So keep perservering, gator, you're kids (present and future) will appreciate it and you will reap untold benefits!
Seeker
from experience -- my daughter has step-children who seldom see their Dad and they are the most obnoxious, spoiled, self-centered beings I have ever had the misfortune to know. They get no discipline and rule their mother's life. Great future generation -- when you consider they are the 'norm' not the exception!

I'm never "nice" when I make demands. You have to remember that those judges and lawyers have no love for you at all. All they care about is making money for themselves. Always be professional, short, sweet, and to the point. The rule of thumb is to say what you have to say, but the less you say, the better.
For someone to "state a claim against you upon which relief may be granted" means, in laymans terms, that you had a valid contract to do business with that person, and you breached that contract. If your ex wife asserts that you owe her child support money, what does that have to do with the judge? NOTHING. The judge is nothing more than a third party debt collector. If your ex has a problem with you, then she should come to you, and the two of you settle your differences under the common law. The judge does not have jurisdiction against a sovereign man unless the sovereign man agrees to enter a contract as such with the judge.
You asked what the options for the Court are. The judge must either state a claim against you upon which relief may be granted, or dismiss the case for failure to state a claim upon which relief may be granted. It's as simple as that.

So consider me dirt ignorant.
I go to court, no matter what is on the docket; be it child support or dissolution or custody or otherwise. I am called before the court to answer to their charges of non payment of child support or otherwise...
What would I do and say through that hearing? What would you do or say?
And, are there cases where people have done what you will recommend and how did they fare, with respect to custody and the like?

its like hooded said in another post its all about contracts,, you have to get this thru your head no matter what as far as faring they the courts and attorneys have to understand that you are not afraid of them,, this is a ll a fear game, every situation is different what you have to understand is what do you realy have to lose by forcing the issue and one final thought none of this is possible as i understand the bible without a deep faith in God. may God bless you remember this the thing abully fears most is the thing that he has inflicted upon his victims

War,
As always thanks for your input. Happy Belated Birthday as well...
I figure, in all this, the least I can do is learn. That way, my child will have a jump on me as he will learn more early on than I have.
