Phone call to Department of Revenue Attorney

I am in Florida.

I have been attempting to get more gainful employment than I have. The companies that want to hire me require that I have a valid Driver's License. These companies are the ones which will pay me more money.

The Dept. of Revenue had my license suspended last year for non payment of ordered support. I received one letter stating the license would be suspended if I did not pay the back support. I never received a letter stating it was in fact suspended.

Before the date the license was to be suspended there was a hearing. Parties present were my ex, her private attorney (the one not directly representing the DOR), my previous attorney, the General Master, and me.

The General Master acknowledged he had no knowledge of the D.O.R.'s involvement, as did my ex's attorney. Nobody knew what was going on with the case, nor the particulars of the case. I informed the GM of the letter I received from the DOR to suspend my license effective later that month. The GM asked if my ex asked for the suspension and she replied "no". The GM asked if her private attorney had anything to do with it and she replied "no". So he said nothing would take effect until the court was informed of the DOR's interest and involvement in this case. For information's sake, the hearing took place in a meeting room and was recorded by audio tape.

So, my license was suspended as was stated by the document from the DOR. My previous attorney tried to get a reinstatement through a motion, but I guess the motions were denied. Now, I cannot get gainful employment.

MY POINT OF ALL THIS IS THAT I WOULD LIKE TO CALL THE DOR ATTORNEY TO FIND OUT WHAT TO DO. HOWEVER, I DO NOT KNOW WHAT TO SAY TO BE CORRECT WITH MY RIGHTS.

Does anyone have any recommendations on things to say that will not make things worse?

I know the license is a contract without full disclosure and all...but in order to work and get paid what I deserve...I need the license. Otherwise, with driving required...they will not hire me.

Maybe I was a little hard on you.

If so, I apologize.

If I were in your shoes, these are the things I would want to know, and I know, from experience, that you can find them out by searching this board and reading till your eyes hurt. [I've done that a few times, trust me]

1. Who am I? (Am I who the State says I am, or who my parents say I am?) [legal name vs. Christian/given - true name]

After that, I can't tell which way I would go. It appears you want to drive professionally, and for that, you will need a license, since the state controls commerce. [just my opinion]

Don't call them... write them.

The first thing you want to find out is WHY THEY BELIEVE THEY ARE A PARTY TO THE ACTION AND WHY THEY BELIEVE THEY HAVE THE AUTHORITY TO ACT.

A simple letter of questions you want answered. Request that they provide proof of their authority by citing relevant law. I'm surprised they didn't cite the "code" that is supposed to give them the authority to act... they usually do in these types of actions.

Once you understand the basics (which you might find by reading your states code) of their action you will be able to formulate some type of action.

Until you receive, in writing, some explanation for their believed authority or their status as a party you have no way of defending against their action.

i dont know where i put it in my posts, but what i did was contract with child support enforcement to get my license back. Like i explained, they wanted $1500 to get my license back. I offered them $300 in a contract. the contract stated that THEY were blocking my ability to comply with the child support order by suspending my license, thus preventing me from gainful employment. They were stuck at this point because, one, they cannot refuse payment of any kind. Two, by refusing the payment, they acknowledge THEIR blocking my ability to comply with the order. Needless to say, i got my license back after 2 years of crap.

I am just quite frustrated about things, due in large part, to not being allowed to see my child. I have never been away from him this long. Anyway, I will read everything mentioned herein.

What is the possibility someone might be able to assist me with drafting a letter of questions I may submit to the DOR?
